Ova tu\u017eba ima za cilj da ustanovi pravednu i aktuelnu kiriju putem suda kada strane ne mogu da postignu sporazum o kiriji.<\/p>\n<div>\n<div class=\"grid-col-1 grid gap-2.5 [&amp;_&gt;&lt;p&gt;p_*]:min-w-0\">\n<p class=\"whitespace-pre-wrap break-words\"><strong>Tu\u017eba za odre\u0111ivanje kirije mo\u017ee biti pokrenuta u slede\u0107im slu\u010dajevima:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Kada ne postoji <strong>nikakva odredba za pove\u0107anje kirije<\/strong> u ugovoru o zakupu za obnovljene periode<\/li>\n<li class=\"whitespace-normal break-words\">Kada je ugovor o zakupu <strong>za period du\u017ei od pet godina<\/strong> ili <strong>se obnavlja nakon pet godina<\/strong><\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Va\u017ena napomena:<\/strong> Tu\u017eba za odre\u0111ivanje kirije mo\u017ee biti pokrenuta samo za <strong>stambene zakupe i pokrivene radionice<\/strong>. <strong>Ovaj tip tu\u017ebe se ne primenjuje na polja, vozila ili drugu pokretnu imovinu.<\/strong><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<div class=\"font-claude-message\">\n<div>\n<div class=\"grid-col-1 grid gap-2.5 [&amp;_&gt;&lt;p&gt;p_*]:min-w-0\">\n<h2 class=\"whitespace-pre-wrap break-words\">Pravni osnov<\/h2>\n<p class=\"whitespace-pre-wrap break-words\">U turskom pravu, tu\u017eba za odre\u0111ivanje kirije je prvenstveno zasnovana na <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.6098.pdf#page=67\">\u010dlanovima 344 i 345 Turskog zakonika o obligacijama (TKK) br. 6098<\/a>.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>\u010clan 344 TKK-a postavlja osnovne principe za odre\u0111ivanje kirije kako sledi:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Sporazumi strana o kiriji koji se primenjuju u obnovljenim periodima zakupa su va\u017ee\u0107i <strong>pod uslovom da ne prelaze<\/strong> procenat varijacije u dvanaestomese\u010dnim prosecima Indeksa potro\u0161a\u010dkih cena (CPI) u prethodnoj zakupnoj godini.<\/li>\n<li class=\"whitespace-normal break-words\">Ako nema sporazuma izme\u0111u strana, kiriju postavlja sudija, ne ve\u0107u od CPI procenta.<\/li>\n<li class=\"whitespace-normal break-words\">U ugovorima o zakupu koji traju du\u017ee od pet godina ili se obnavljaju nakon pet godina, kiriju postavlja sudija na po\u0161ten na\u010din, uzimaju\u0107i u obzir CPI procenat, stanje iznajmljene imovine i uporedive kirije.<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">\u010clan 345 TKK-a pak uvodi regulativu koja se odnosi na vreme pokretanja tu\u017ebe za odre\u0111ivanje kirije i period primene odluke. Ovi uslovi su od velikog zna\u010daja za prihvatljivost tu\u017ebe i pravilno izvr\u0161avanje sudskog postupka.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">1 &#8211; Postojanje va\u017ee\u0107eg ugovora o zakupu<\/h3>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Za pokretanje tu\u017ebe za odre\u0111ivanje kirije, prvo mora postojati va\u017ee\u0107i ugovor o zakupu izme\u0111u strana:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Ugovor o zakupu mo\u017ee biti pismen ili usmen. Turski zakonik o obligacijama ne zahteva pisanu formu za ugovore o zakupu.<\/li>\n<li class=\"whitespace-normal break-words\">Va\u017enost ugovora mora biti zasnovana na uzajamnim i kompatibilnim izjavama volje strana.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Va\u017ena napomena:<\/strong> Teret dokazivanja postojanja ugovora o zakupu pripada strani koja pokre\u0107e tu\u017ebu. Dakle, posebno kod usmenih ugovora o zakupu, va\u017eno je predstaviti dokaze koji dokazuju postojanje i sadr\u017eaj ugovora.<\/p>\n<\/blockquote>\n<h3 class=\"whitespace-pre-wrap break-words\">2 &#8211; Postojanje legitimnog interesa<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">U turskom pravnom sistemu, kao i kod svih tipova tu\u017ebi, mora postojati legitiman interes za tu\u017eioca u tu\u017ebi za odre\u0111ivanje kirije.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Legitiman interes se smatra postoje\u0107im u slede\u0107im situacijama:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Strane nisu postigle sporazum o kiriji za novi period zakupa<\/li>\n<li class=\"whitespace-normal break-words\">Trenutna kirija nije u skladu sa trenutnim ekonomskim uslovima<\/li>\n<li class=\"whitespace-normal break-words\">Ne postoji nikakva odredba za pove\u0107anje kirije u ugovoru o zakupu, ili bi primena postoje\u0107e odredbe dovela do nepravednih rezultata<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">U odluci Kasacionog suda je presu\u0161eno da &#8222;(&#8230;) za pokretanje tu\u017ebe za odre\u0111ivanje kirije, tu\u017eilac mora imati legitiman interes u pokretanju ove tu\u017ebe. Ina\u010de tu\u017eba mora biti odba\u0107ena zbog nedostatka legitimnog interesa (&#8230;)&#8220;, nagla\u0161avaju\u0107i va\u017enost legitimnog interesa.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">3 &#8211; Uslov petogodi\u0161njeg perioda<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">\u010clan 344, paragraf 3 Turskog zakonika o obligacijama uvodi va\u017ean vremenski zahtev za pokretanje tu\u017ebe za odre\u0111ivanje kirije.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Uslov petogodi\u0161njeg perioda se primenjuje kako sledi:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Ako je ugovor o zakupu za period du\u017ei od pet godina ili se obnavlja nakon pet godina, mo\u017ee biti pokrenuta tu\u017eba za odre\u0111ivanje kirije nezavisno od postojanja sporazuma izme\u0111u strana.<\/li>\n<li class=\"whitespace-normal break-words\">Pre nego \u0161to ovaj period istekne, tu\u017eba za odre\u0111ivanje kirije mo\u017ee biti pokrenuta samo ako ne postoji nikakva odredba za pove\u0107anje kirije u ugovoru.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\">Va\u017ena napomena: Uslov petogodi\u0161njeg perioda je regulativa uvedena za za\u0161titu zakupca. Pre nego \u0161to ovaj period istekne, ako postoji odredba za pove\u0107anje kirije u ugovoru, ne mo\u017ee biti pokrenuta tu\u017eba za odre\u0111ivanje kirije, i primenjuje se odredba u ugovoru.<\/p>\n<\/blockquote>\n<p class=\"whitespace-pre-wrap break-words\">U Turskoj, ova tri osnovna uslova moraju koegzistirati u tu\u017ebama za odre\u0111ivanje kirije. Odsustvo jednog od ovih uslova mo\u017ee dovesti do odbacivanja tu\u017ebe. U ovom odeljku razgovaramo o aspektima koji se odnose na pokretanje tu\u017ebe.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">1 &#8211; Nadle\u017ean i Ovla\u0161\u0107en Sud<\/h3>\n<p class=\"whitespace-pre-wrap break-words\"><strong>U turskom pravnom sistemu, nadle\u017ean i ovla\u0161\u0107en sud za sporove koji se ti\u010du utvr\u0111ivanja iznosa kirije ustanovljava se na slede\u0107i na\u010din:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\"><strong>Nadle\u017ean Sud:<\/strong> Sporovi za utvr\u0111ivanje iznosa kirije spadaju u nadle\u017enost Mirnih Gra\u0111anskih Sudova (Na turskom: Sulh Hukuk Mahkemesi)<\/li>\n<li class=\"whitespace-normal break-words\"><strong>Ovla\u0161\u0107en Sud<\/strong>: Spor mo\u017ee biti pokrenut pred sudom mesta gde se nalazi iznajmljena nekretnina ili pred sudom mesta gde \u017eivi tu\u017eeni.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Ta\u010dka pa\u017enje:<\/strong> Ako je neki drugi sud odre\u0111en kao nadle\u017ean putem sporazuma o nadle\u017enosti, spor mo\u017ee biti pokrenut i pred tim sudom. U slu\u010dajevima gde zakupac ima status potro\u0161a\u010da, me\u0111utim, primenjuju se pravila nadle\u017enosti u korist potro\u0161a\u010da.<\/p>\n<\/blockquote>\n<h3 class=\"whitespace-pre-wrap break-words\">2 &#8211; Rok za Pokretanje Spora<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">\u010clan 345 turskog Zakonika o obavezama uvodi va\u017ene odredbe koje se ti\u010du momenta pokretanja spora za utvr\u0111ivanje iznosa kirije.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Osnovna pravila koja se ti\u010du roka za pokretanje spora su slede\u0107a:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Spor za utvr\u0111ivanje iznosa kirije mo\u017ee biti pokrenut u bilo kom trenutku.<\/li>\n<li class=\"whitespace-normal break-words\">Za iznos kirije koji \u0107e biti va\u017ee\u0107i od novog perioda zakupa, me\u0111utim, spor mora biti pokrenut <strong>najmanje 30 dana pre<\/strong> po\u010detka novog perioda.<\/li>\n<li class=\"whitespace-normal break-words\">Ako je zakupodavac dao <strong>pismeno obave\u0161tenje<\/strong> zakupcu u okviru ovog perioda od 30 dana, mogu pokrenuti spor do kraja slede\u0107eg novog perioda zakupa.<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">U odluci Kasacionog suda ustanovljeno je da &#8222;(&#8230; ) u sporovima za utvr\u0111ivanje iznosa kirije, datum od kojeg \u0107e se primenjivati ustanovljeni iznos kirije zavisi od datuma kada je spor pokrenut i vremena obave\u0161tavanja zakupca od strane zakupodavca (&#8230; )&#8220;, nagla\u0161avaju\u0107i va\u017enost vremena pokretanja spora.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">3 &#8211; Priprema Zahteva za Tu\u017ebu<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">Spor za utvr\u0111ivanje iznosa kirije pokre\u0107e se pravilno pripremljenim zahtevom za tu\u017ebu.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Osnovni elementi koji moraju biti uklju\u010deni u zahtev za tu\u017ebu su:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Ime, prezime i adrese tu\u017eioca i tu\u017eenog<\/li>\n<li class=\"whitespace-normal break-words\">Predmet spora i zahtevani iznos kirije<\/li>\n<li class=\"whitespace-normal break-words\">Datum i sadr\u017eaj ugovora o zakupu koji je predmet spora<\/li>\n<li class=\"whitespace-normal break-words\">Materijalni i pravni razlozi na kojima se spor zasniva<\/li>\n<li class=\"whitespace-normal break-words\">U \u010demu se sastoji dokaz<\/li>\n<li class=\"whitespace-normal break-words\">Zaklju\u010dak zahteva<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Ta\u010dka pa\u017enje:<\/strong> Iznos kirije zahtevani u zahtevu za tu\u017ebu mora biti naveden <strong>jasno<\/strong>. U ovom odeljku fokusiramo se na implementaciju i posledice odluke suda.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">1 &#8211; Vreme primene odluke<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">\u010clan 345 turskog Zakona o obavezama reguli\u0161e vreme primene odluke date kao rezultat parnice za odre\u0111ivanje cene zakupnine.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Osnovna pravila u vezi sa vremenom primene odluke su slede\u0107a:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Ako se parnica pokrene <strong>najmanje 30 dana pre<\/strong> po\u010detka novog perioda zakupa, odluka se primenjuje od po\u010detka novog perioda zakupa.<\/li>\n<li class=\"whitespace-normal break-words\">Ako je zakupodavac dao pisano obave\u0161tenje da \u0107e do\u0107i do pove\u0107anja zakupnine 30 dana pre novog perioda i parnica se pokrene pre kraja novog perioda, odluka se ponovo primenjuje <strong>od po\u010detka novog perioda<\/strong>.<\/li>\n<li class=\"whitespace-normal break-words\">Ako ovi uslovi nisu ispunjeni, odluka se primenjuje <strong>od po\u010detka slede\u0107eg perioda zakupa<\/strong>.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\">Napomena: Vreme primene odluke je kriti\u010dno u smislu spre\u010davanja potencijalnog gubitka prihoda od zakupnine za zakupodavca.<\/p>\n<\/blockquote>\n<p>Stoga treba obratiti pa\u017enju na vremenske rokove pre pokretanja parnice.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">2 &#8211; Pitanje retroaktivnog dejstva<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">U turskom pravnom sistemu, pitanje retroaktivnog dejstva odluka u parnicama za odre\u0111ivanje zakupnine je kontroverzno.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Slede\u0107e ta\u010dke se izdvajaju u pogledu retroaktivnog dejstva:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Kao op\u0161te pravilo, odluke za odre\u0111ivanje kirije se primenjuju <strong>prospektivno<\/strong>.<\/li>\n<li class=\"whitespace-normal break-words\">Me\u0111utim, ako stanodavac po\u0161alje ispravno <strong>obave\u0161tenje<\/strong> pre nego \u0161to se pokrene tu\u017eba, mogu\u0107e je da se odluka suda primeni <strong>od datuma obave\u0161tenja<\/strong>.<\/li>\n<li class=\"whitespace-normal break-words\">Jurisprudencija Kasacionog suda o ovom pitanju mo\u017ee se menjati tokom vremena.<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">U jednoj odluci Kasacionog suda utvr\u0111eno je da &#8222;(&#8230; ) u tu\u017ebama za odre\u0111ivanje kirije, retroaktivna primena iznosa kirije je mogu\u0107a samo ako stanodavac po\u0161alje ispravno obave\u0161tenje i doka\u017ee da je ovo obave\u0161tenje uru\u010deno (&#8230; )&#8220;, precizno specificiraju uslove za retroaktivnu primenu.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">3 &#8211; \u017dalba protiv odluke<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">Strane mogu da podnesu \u017ealbu protiv odluke date nakon tu\u017ebe za odre\u0111ivanje iznosa kirije.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Slede\u0107e ta\u010dke su va\u017ene u postupku \u017ealbe:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Mo\u017ee se podneti \u017ealba protiv odluke suda prvog stepena.<\/li>\n<li class=\"whitespace-normal break-words\">Pod odre\u0111enim uslovima, odluka apelacionog suda mo\u017ee biti izneta pred Kasacioni sud.<\/li>\n<li class=\"whitespace-normal break-words\">Ocenu \u017ealbe vr\u0161i Kasacioni sud.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Ta\u010dka za napomenu:<\/strong> Trostepenski sudski sistem je implementiran u Turskoj od 2016. godine. Stoga, u tu\u017ebama za odre\u0111ivanje kirije je <strong>potrebno prvo podneti \u017ealbu, a potom, ako se zadovolje potrebni uslovi, i\u0107i pred Kasacioni sud<\/strong>.<\/p>\n<\/blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Ta\u010dke koje treba razmotriti u postupku \u017ealbe su slede\u0107e:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Rok za \u017ealbu je <strong>dve nedelje<\/strong> od uru\u010denja odluke.<\/li>\n<li class=\"whitespace-normal break-words\">Razlozi \u017ealbe moraju biti navedeni <strong>jasno<\/strong> u molbi za \u017ealbu.<\/li>\n<li class=\"whitespace-normal break-words\">Ocena \u017ealbe se obi\u010dno vr\u0161i <strong>po aktima<\/strong>, ali Kasacioni sud mo\u017ee odr\u017eati <strong>ro\u010di\u0161te<\/strong> ako smatra da je potrebno.<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">U turskom pravnom sistemu, odluke date nakon tu\u017ebi za odre\u0111ivanje iznosa kirije direktno uti\u010du na odnos zakupa izme\u0111u strana.
