Odnos izme\u0111u stanara i vlasnika nekretnine u Turskoj primarno je regulisan Turskim zakonom o obligacijama (T\u00fcrk Bor\u00e7lar Kanunu, TBK) br. 6098, konkretno \u010dlanovima 299 do 355, koji utvr\u0111uju pravni okvir za ugovore o zakupu, prava i obaveze obe strane. Tursko pravo se generalno smatra naklonjenim stanarima, a pravni sistem pru\u017ea dugoro\u010dnu sigurnost i sna\u017enu za\u0161titu od delo\u017eacije i proizvoljnog pove\u0107anja stanarine.<\/p>\n<h2>Ugovor o Zakupu: Pisani ili Usmeni?<\/h2>\n<p>Ugovori o zakupu u Turskoj mogu biti zaklju\u010deni u pisanoj ili usmenoj formi, pri \u010demu su oba oblika pravno valjana. Ipak, pisani ugovor se sna\u017eno preporu\u010duje jer pru\u017ea jasne dokaze u slu\u010daju spora. Turski zakon o obligacijama \u0161titi stanare bez obzira na formu ugovora, osiguravaju\u0107i da njihova prava ostanu na snazi u oba slu\u010daja. Standardni ugovor o zakupu obi\u010dno traje godinu dana i automatski se produ\u017eava ukoliko nijedna strana ne da otkaz u propisanom roku. Ovaj mehanizam automatskog produ\u017eenja jedan je od temeljnih oblika za\u0161tite stanara, jer spre\u010dava vlasnike nekretnine da jednostavno okon\u010daju zakup po isteku ugovornog perioda bez zakonskog opravdanja.<\/p>\n<p>Zakonska definicija ugovora o zakupu jasno je utvr\u0111ena u zakonu. Prema \u010dlanu 299 Turskog zakona o obligacijama, zakupodavac je strana koja se obavezuje da zakupcu prepusti kori\u0161\u0107enje ili u\u017eivanje iznajmljene stvari u zamenu za odre\u0111enu naknadu. Pored toga, \u010dlan 301 obavezuje zakupodavce da odr\u017eavaju nekretninu u stanju pogodnom za predvi\u0111enu upotrebu i da vr\u0161e neophodne popravke, osim ukoliko je \u0161tetu prouzrokovao sam stanar.<\/p>\n<h2>Za\u0161tita od Pove\u0107anja Stanarine<\/h2>\n<p>Jedna od najzna\u010dajnijih zakonskih za\u0161tita stanara u turskom pravu odnosi se na na\u010din na koji se stanarina mo\u017ee pove\u0107avati. Pove\u0107anja stanarine u Turskoj regulisana su Turskim zakonom o obligacijama br. 6098 i prate\u0107im propisima. Za stambene zakupe, pove\u0107anje stanarine izra\u010dunava se na osnovu Indeksa potro\u0161a\u010dkih cena (IPC), koji objavljuje Turski statisti\u010dki zavod (T\u00dc\u0130K).<\/p>\n<p>Relevantna zakonska odredba glasi:<\/p>\n<p><em>\u010clan 344 Turskog zakona o obligacijama \u2013 Sporazumi izme\u0111u strana o visini stanarine koja se primenjuje u produ\u017eenim periodima zakupa su valjani, pod uslovom da stopa promene ne prelazi dvanaestomese\u010dni prosek indeksa potro\u0161a\u010dkih cena prethodne zakupne godine.<\/em><\/p>\n<p>Zakonom je propisano da se stanarina mo\u017ee pove\u0107ati samo jednom godi\u0161nje, i to isklju\u010divo pri obnavljanju ugovora o zakupu. Ukoliko vlasnik nekretnine zahteva pove\u0107anje stanarine iznad zakonskog maksimuma, stanar nije du\u017ean da to prihvati. U slu\u010daju spora, stanar mo\u017ee podneti tu\u017ebu sudu za utvr\u0111ivanje visine stanarine kako bi za\u0161titio svoja prava. Tako\u0111e je va\u017eno napomenuti da vlasnik nekretnine i stanar mogu sporazumno ugovoriti ni\u017ei procenat pove\u0107anja od zakonskog maksimuma, ukoliko obe strane na to pristanu.<\/p>\n<p>Istorijski gledano, privremena vladina mera ograni\u010dila je pove\u0107anje stanarine za stambene nekretnine na 25% u periodu od juna 2022. do jula 2024. godine. Ovo ograni\u010denje je isteklo 1. jula 2024. godine, a od tada se pove\u0107anja izra\u010dunavaju isklju\u010divo na osnovu inflacije, odnosno IPC-a. Iako je ova specifi\u010dna granica prestala da va\u017ei, pravilo o IPC-u i dalje \u0161titi stanare od nesrazmernih pove\u0107anja.<\/p>\n<h2>Prava u Pogledu Depozita<\/h2>\n<p>Vlasnici nekretnina u Turskoj mogu zahtevati depozit, ali taj iznos ne sme biti ve\u0107i od tromese\u010dne stanarine. Rukovanje ovim depozitom tako\u0111e je regulisano zakonom. Prema turskom pravu, depozit mora biti polo\u017een na oro\u010deni ra\u010dun koji vlasnik otvara na ime stanara. Ukoliko se depozit pla\u0107a u gotovini, mora se \u010duvati na bankovnom ra\u010dunu i prinositi kamatu. Depozit se mo\u017ee vratiti isklju\u010divo uz obostrani pristanak ili na osnovu pravosna\u017ene sudske odluke.<\/p>\n<p>Vlasnik je du\u017ean da vrati depozit po isteku zakupa, pod uslovom da je nekretnina u dobrom stanju. U slu\u010daju spora, vlasnik mora pru\u017eiti dokaze koji opravdavaju zadr\u017eavanje depozita. U situacijama kada vlasnik bez opravdanog razloga odbija da vrati depozit, stanar ima pravo da zatra\u017ei re\u0161enje putem medijacije ili sudskim putem.<\/p>\n<h2>Za\u0161tita od Nezakonitog Iseljenja<\/h2>\n<p>Tursko pravo pru\u017ea sna\u017enu za\u0161titu od nezakonitog iseljenja. Stanar ne mo\u017ee biti proizvoljno iseljen \u010dak ni po isteku ugovornog perioda. Pravo vlasnika na iseljenje mora se zasnivati na opravdanim i konkretnim razlozima jasno navedenim u zakonu, kao \u0161to su li\u010dna potreba, rekonstrukcija, pisana izjava o iseljavanju ili nepla\u0107anje stanarine od strane stanara.<\/p>\n<p>\u010clan 352 Turskog zakona o obligacijama propisuje da vlasnik mora dati pisano obave\u0161tenje o otkazu najmanje tri meseca pre isteka zakupnog perioda, ukoliko se radi o pisanom ugovoru na odre\u0111eno vreme. Za ugovore na neodre\u0111eno vreme, vlasnik je tako\u0111e du\u017ean da da otkazni rok od najmanje tri meseca.<\/p>\n<p>Vlasnik ne mo\u017ee iseliti stanara samo zbog toga \u0161to je ugovor istekao. Mora navesti zakonski osnov ili sa\u010dekati desetu godinu obnavljanja ugovora u slu\u010daju stambenog zakupa ili zakupa poslovnog prostora sa krovom. Ukoliko vlasnik proda nekretninu, zakup se nastavlja pod istim uslovima sa novim vlasnikom. Prodaja nekretnine ne okon\u010dava ugovor o zakupu.<\/p>\n<h2>Odr\u017eavanje, Popravke i Tro\u0161kovi Nekretnine<\/h2>\n<p>Tro\u0161kovi koji nisu neposredno vezani za kori\u0161\u0107enje nekretnine od strane stanara padaju na teret vlasnika. Ukoliko stanar ipak pokrije te tro\u0161kove, ima pravo da ih odbije od iznosa stanarine. Na primer, bojenje spolja\u0161njosti zgrade je odgovornost vlasnika, mada se ugovorom mo\u017ee druga\u010dije dogovoriti. Ukoliko postoje nedostaci pre nego \u0161to stanar preuzme nekretninu, stanar mo\u017ee zahtevati da vlasnik izvr\u0161i potrebne popravke. Alternativno, stanar mo\u017ee pristati da sam pokrije tro\u0161kove popravke i odbije ih od narednih pla\u0107anja stanarine.<\/p>\n<p>Stanari su odgovorni za tro\u0161kove koji proisti\u010du iz njihovog kori\u0161\u0107enja nekretnine, kao \u0161to su voda, struja i gas. Me\u0111utim, ve\u0107e strukturalne popravke, porez na imovinu i obavezno osiguranje od zemljotresa su odgovornost vlasnika.<\/p>\n<p>Tursko pravo o zakupu pravi jasnu razliku izme\u0111u namerne \u0161tete i normalnog habanja. Postoji razlika izme\u0111u o\u0161te\u0107enja i o\u010dekivanog amortizovanja nekretnine usled normalnog kori\u0161\u0107enja tokom vremena. Stanari ne mogu biti odgovorni za potonje, \u0161to im pru\u017ea za\u0161titu od neosnovanih zahteva.<\/p>\n<h2>Re\u0161avanje Sporova<\/h2>\n<p>U slu\u010daju spora izme\u0111u stanara i vlasnika nekretnine, \u010dlanovi 316 i 340 Turskog zakona o obligacijama utvr\u0111uju posebne postupke za re\u0161avanje uobi\u010dajenih sukoba, kao \u0161to su nepla\u0107anje stanarine i o\u0161te\u0107enje imovine. Medijacija, kako to podsti\u010de Turski zakon o medijaciji br. 6325, pru\u017ea alternativni put i promovi\u0161e mirno re\u0161avanje sporova pre pokretanja sudskog postupka.<\/p>\n<p>Ukoliko ugovor o zakupu ne sadr\u017ei odredbu o pove\u0107anju stanarine, vlasnik nema automatsko pravo da pove\u0107a stanarinu. Me\u0111utim, vlasnik mo\u017ee pokrenuti sudski postupak za utvr\u0111ivanje visine stanarine kako bi zatra\u017eio uskla\u0111ivanje. U takvim slu\u010dajevima, sud utvr\u0111uje pove\u0107anje stanarine na osnovu Indeksa potro\u0161a\u010dkih cena i u skladu s tim reguli\u0161e obaveze pla\u0107anja stanara.<\/p>\n<h2>Prava Stranih Stanara<\/h2>\n<p>Prava stranih stanara u Turskoj u velikoj meri su ista kao prava turskih dr\u017eavljana na osnovu Turskog zakona o obligacijama. Vlasnici nekretnina ne smeju druga\u010dije postupati prema stanarima na osnovu njihovog dr\u017eavljanstva. Strani stanari su zakonski za\u0161ti\u0107eni u okviru istog sistema kao i lokalni stanari. Strani rezidenti koji iznajmljuju nekretnine u Turskoj imaju pravo na iste za\u0161tite u pogledu iseljenja, pove\u0107anja stanarine, povra\u0107aja depozita i odr\u017eavanja nekretnine kao i svaki drugi stanar.<\/p>\n<p>Od izuzetne je va\u017enosti da stanari budu potpuno informisani o svojim pravima u predugovornoj fazi, tokom trajanja ugovora i u fazi iseljenja, kao i da budu svesni pravnih sredstava koja su im na raspolaganju u slu\u010daju kr\u0161enja tih prava.
