Denna r\u00e4tteg\u00e5ng syftar till att fastst\u00e4lla ett r\u00e4ttvist och aktuellt hyresbelopp via domstolen n\u00e4r parterna inte kan komma \u00f6verens om hyresbeloppet.<\/p>\n<div>\n<div class=\"grid-col-1 grid gap-2.5 [&amp;_&gt;&lt;p&gt;p_*]:min-w-0\">\n<p class=\"whitespace-pre-wrap break-words\"><strong>R\u00e4tteg\u00e5ngen f\u00f6r fastst\u00e4llande av hyresbelopp kan v\u00e4ckas i f\u00f6ljande fall:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">N\u00e4r det <strong>inte finns n\u00e5gon best\u00e4mmelse f\u00f6r hyresh\u00f6jning<\/strong> i hyreskontraktet f\u00f6r f\u00f6rnyade perioder<\/li>\n<li class=\"whitespace-normal break-words\">N\u00e4r hyreskontrakt <strong>g\u00e4ller f\u00f6r en period l\u00e4ngre \u00e4n fem \u00e5r<\/strong> eller <strong>f\u00f6rnyas efter fem \u00e5r<\/strong><\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Viktig punkt:<\/strong> R\u00e4tteg\u00e5ngen f\u00f6r hyresfastst\u00e4llande kan endast v\u00e4ckas f\u00f6r <strong>bost\u00e4der och t\u00e4ckta verkst\u00e4der<\/strong>. <strong>Denna typ av r\u00e4tteg\u00e5ng g\u00e4ller inte f\u00f6r f\u00e4lt, fordon eller andra l\u00f6s\u00f6re.<\/strong><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<div class=\"font-claude-message\">\n<div>\n<div class=\"grid-col-1 grid gap-2.5 [&amp;_&gt;&lt;p&gt;p_*]:min-w-0\">\n<h2 class=\"whitespace-pre-wrap break-words\">Juridisk grund<\/h2>\n<p class=\"whitespace-pre-wrap break-words\">I turkisk r\u00e4tt baseras r\u00e4tteg\u00e5ngen f\u00f6r fastst\u00e4llande av hyresbelopp huvudsakligen p\u00e5 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.6098.pdf#page=67\">artiklarna 344 och 345 i den turkiska obligationslagen (TOL) nr. 6098<\/a>.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>TOL artikel 344 fastst\u00e4ller grundprinciperna f\u00f6r fastst\u00e4llande av hyresbelopp enligt f\u00f6ljande:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Parternas \u00f6verenskommelser om hyresbelopp som till\u00e4mpas under f\u00f6rnyade hyresperioder \u00e4r giltiga <strong>f\u00f6rutsatt att de inte \u00f6verskrider<\/strong> f\u00f6r\u00e4ndringsprocenten i tolvm\u00e5nadersgenomsnitten av konsumentprisindex (KPI) under f\u00f6reg\u00e5ende hyres\u00e5r.<\/li>\n<li class=\"whitespace-normal break-words\">Om det inte finns n\u00e5gon \u00f6verenskommelse mellan parterna, fastst\u00e4lls hyresbeloppet av domaren, inte h\u00f6gre \u00e4n KPI-procenten.<\/li>\n<li class=\"whitespace-normal break-words\">I hyreskontrakt som varar l\u00e4ngre \u00e4n fem \u00e5r eller f\u00f6rnyas efter fem \u00e5r, fastst\u00e4lls hyresbeloppet av domaren p\u00e5 ett r\u00e4ttvist s\u00e4tt, med h\u00e4nsyn till KPI-procenten, den hyrda egendomens tillst\u00e5nd och j\u00e4mf\u00f6rbara hyresbelopp.<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">TOL artikel 345 d\u00e4remot introducerar reglering ang\u00e5ende tidpunkten f\u00f6r v\u00e4ckande av r\u00e4tteg\u00e5ng f\u00f6r fastst\u00e4llande av hyresbelopp och perioden f\u00f6r till\u00e4mpning av beslutet. Den turkiska obligationslagen kr\u00e4ver inte skriftlig form f\u00f6r hyreskontrakt.<\/li>\n<li class=\"whitespace-normal break-words\">Kontraktets giltighet m\u00e5ste baseras p\u00e5 parternas \u00f6msesidiga och kompatibla viljef\u00f6rklaringar.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Viktig punkt:<\/strong> Bevisb\u00f6rdan f\u00f6r hyreskontrakt existens ligger p\u00e5 den part som v\u00e4cker r\u00e4tteg\u00e5ngen. D\u00e4rf\u00f6r \u00e4r det, s\u00e4rskilt vid muntliga hyreskontrakt, viktigt att presentera bevis som bevisar kontraktets existens och inneh\u00e5ll.<\/p>\n<\/blockquote>\n<h3 class=\"whitespace-pre-wrap break-words\">2 &#8211; Existens av ber\u00e4ttigat intresse<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">I det turkiska r\u00e4ttssystemet, liksom vid alla typer av r\u00e4tteg\u00e5ngar, m\u00e5ste det finnas ett ber\u00e4ttigat intresse f\u00f6r k\u00e4randen i r\u00e4tteg\u00e5ngen f\u00f6r fastst\u00e4llande av hyresbelopp.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Ber\u00e4ttigat intresse anses existera i f\u00f6ljande situationer:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Parterna har inte n\u00e5tt \u00f6verenskommelse om hyresbeloppet f\u00f6r den nya hyresperioden<\/li>\n<li class=\"whitespace-normal break-words\">Det nuvarande hyresbeloppet \u00e4r inte i \u00f6verensst\u00e4mmelse med nuvarande ekonomiska f\u00f6rh\u00e5llanden<\/li>\n<li class=\"whitespace-normal break-words\">Det finns ingen best\u00e4mmelse f\u00f6r hyresh\u00f6jning i hyreskontraktet, eller till\u00e4mpning av den befintliga best\u00e4mmelsen skulle leda till or\u00e4ttvisa resultat<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">I ett beslut fr\u00e5n Kassationsdomstolen bed\u00f6mdes att &#8221;(&#8230;) f\u00f6r v\u00e4ckande av r\u00e4tteg\u00e5ng f\u00f6r fastst\u00e4llande av hyresbelopp m\u00e5ste k\u00e4randen ha ett ber\u00e4ttigat intresse av att v\u00e4cka denna r\u00e4tteg\u00e5ng. Annars m\u00e5ste r\u00e4tteg\u00e5ngen avvisas p\u00e5 grund av brist p\u00e5 ber\u00e4ttigat intresse (&#8230;)&#8221;, vilket betonade vikten av ber\u00e4ttigat intresse.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">3 &#8211; Fem-\u00e5rs periodvillkor<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">Artikel 344, paragraf 3 i den turkiska obligationslagen introducerar ett viktigt tidsvillkor f\u00f6r v\u00e4ckande av r\u00e4tteg\u00e5ng f\u00f6r fastst\u00e4llande av hyresbelopp.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Fem-\u00e5rs periodvillkoret till\u00e4mpas enligt f\u00f6ljande:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Om hyreskontraktet g\u00e4ller f\u00f6r en period l\u00e4ngre \u00e4n fem \u00e5r eller f\u00f6rnyas efter fem \u00e5r, kan en r\u00e4tteg\u00e5ng f\u00f6r hyresfastst\u00e4llande v\u00e4ckas oavsett om det finns \u00f6verenskommelse mellan parterna.<\/li>\n<li class=\"whitespace-normal break-words\">Innan denna period l\u00f6per ut kan r\u00e4tteg\u00e5ng f\u00f6r fastst\u00e4llande av hyresbelopp endast v\u00e4ckas om det inte finns n\u00e5gon best\u00e4mmelse f\u00f6r hyresh\u00f6jning i kontraktet.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\">Viktig punkt: Fem-\u00e5rs periodvillkoret \u00e4r en reglering som inf\u00f6rts f\u00f6r att skydda hyresg\u00e4sten. Innan denna period l\u00f6per ut, om det finns en best\u00e4mmelse f\u00f6r hyresh\u00f6jning i kontraktet, kan r\u00e4tteg\u00e5ng f\u00f6r hyresfastst\u00e4llande inte v\u00e4ckas, och best\u00e4mmelsen i kontraktet till\u00e4mpas.<\/p>\n<\/blockquote>\n<p class=\"whitespace-pre-wrap break-words\">I Turkiet m\u00e5ste dessa tre grundl\u00e4ggande villkor existera tillsammans i r\u00e4tteg\u00e5ngar f\u00f6r fastst\u00e4llande av hyresbelopp. Avsaknad av n\u00e5got av dessa villkor kan leda till avvisning av r\u00e4tteg\u00e5ngen. I denna del diskuterar vi aspekterna relaterade till v\u00e4ckande av r\u00e4tteg\u00e5ngen.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">1 &#8211; Beh\u00f6rig och Auktoriserad Domstol<\/h3>\n<p class=\"whitespace-pre-wrap break-words\"><strong>I det turkiska r\u00e4ttssystemet best\u00e4ms den beh\u00f6riga och auktoriserade domstolen f\u00f6r r\u00e4ttsfall r\u00f6rande fastst\u00e4llande av hyresbelopp enligt f\u00f6ljande:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\"><strong>Beh\u00f6rig Domstol:<\/strong> R\u00e4ttsfall f\u00f6r fastst\u00e4llande av hyresbelopp faller under jurisdiktionen av Civila Fredsdomstolar (P\u00e5 turkiska: Sulh Hukuk Mahkemesi)<\/li>\n<li class=\"whitespace-normal break-words\"><strong>Auktoriserad Domstol<\/strong>: R\u00e4ttsfallet kan v\u00e4ckas vid domstolen p\u00e5 den plats d\u00e4r den hyrda fastigheten \u00e4r bel\u00e4gen eller vid domstolen p\u00e5 den plats d\u00e4r svaranden bor.<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Uppm\u00e4rksamhetspunkt:<\/strong> Om en annan domstol har utsetts som beh\u00f6rig genom ett jurisdiktionsavtal, kan r\u00e4ttsfallet \u00e4ven v\u00e4ckas vid denna domstol. I fall d\u00e4r hyresg\u00e4sten har konsumentstatus till\u00e4mpas dock jurisdiktionsreglerna till f\u00f6rm\u00e5n f\u00f6r konsumenten.<\/p>\n<\/blockquote>\n<h3 class=\"whitespace-pre-wrap break-words\">2 &#8211; Tidsfrist f\u00f6r V\u00e4ckande av R\u00e4ttsfall<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">Artikel 345 i den turkiska F\u00f6rbindelselagen introducerar viktiga best\u00e4mmelser r\u00f6rande tidpunkten f\u00f6r v\u00e4ckande av r\u00e4ttsfall f\u00f6r fastst\u00e4llande av hyresbelopp.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Grundreglerna r\u00f6rande tidsfristen f\u00f6r v\u00e4ckande av r\u00e4ttsfall \u00e4r f\u00f6ljande:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Ett r\u00e4ttsfall f\u00f6r fastst\u00e4llande av hyresbelopp kan v\u00e4ckas n\u00e4r som helst.<\/li>\n<li class=\"whitespace-normal break-words\">F\u00f6r det hyresbelopp som ska g\u00e4lla fr\u00e5n den nya hyresperioden m\u00e5ste r\u00e4ttsfallet dock v\u00e4ckas <strong>minst 30 dagar f\u00f6re<\/strong> b\u00f6rjan av den nya perioden.<\/li>\n<li class=\"whitespace-normal break-words\">Om hyresv\u00e4rden inom denna 30-dagarsperiod har gett <strong>skriftlig underr\u00e4ttelse<\/strong> till hyresg\u00e4sten, kan de v\u00e4cka r\u00e4ttsfall fram till slutet av n\u00e4sta nya hyresperiod.<\/li>\n<\/ul>\n<p class=\"whitespace-pre-wrap break-words\">I ett beslut fr\u00e5n Kassationsdomstolen bed\u00f6mdes att &#8221;(&#8230; ) i r\u00e4ttsfall f\u00f6r fastst\u00e4llande av hyresbelopp beror datumet fr\u00e5n vilket det fastst\u00e4llda hyresbeloppet ska till\u00e4mpas p\u00e5 datumet d\u00e5 r\u00e4ttsfallet v\u00e4cktes och tidpunkten f\u00f6r hyresv\u00e4rdens underr\u00e4ttelse till hyresg\u00e4sten (&#8230; )&#8221;, vilket betonade vikten av tidpunkten f\u00f6r v\u00e4ckande av r\u00e4ttsfallet.<\/p>\n<h3 class=\"whitespace-pre-wrap break-words\">3 &#8211; F\u00f6rberedelse av St\u00e4mningsans\u00f6kan<\/h3>\n<p class=\"whitespace-pre-wrap break-words\">R\u00e4ttsfallet f\u00f6r fastst\u00e4llande av hyresbelopp v\u00e4cks med en korrekt f\u00f6rberedd st\u00e4mningsans\u00f6kan.<\/p>\n<p class=\"whitespace-pre-wrap break-words\"><strong>De grundl\u00e4ggande element som m\u00e5ste inkluderas i st\u00e4mningsans\u00f6kan \u00e4r:<\/strong><\/p>\n<ul class=\"-mt-1 list-disc space-y-2 pl-8\">\n<li class=\"whitespace-normal break-words\">Namn, efternamn och adresser f\u00f6r k\u00e4rande och svarande<\/li>\n<li class=\"whitespace-normal break-words\">R\u00e4ttsfalls\u00e4mne och det beg\u00e4rda hyresbeloppet<\/li>\n<li class=\"whitespace-normal break-words\">Datum och inneh\u00e5ll f\u00f6r hyresavtalet som \u00e4r f\u00f6rem\u00e5l f\u00f6r r\u00e4ttsfallet<\/li>\n<li class=\"whitespace-normal break-words\">Materiella och juridiska sk\u00e4l som r\u00e4ttsfallet baseras p\u00e5<\/li>\n<li class=\"whitespace-normal break-words\">Vad bevisningen best\u00e5r av<\/li>\n<li class=\"whitespace-normal break-words\">Ans\u00f6kans slutsats<\/li>\n<\/ul>\n<blockquote>\n<p class=\"whitespace-pre-wrap break-words\"><strong>Uppm\u00e4rksamhetspunkt:<\/strong> Det hyresbelopp som beg\u00e4rs i st\u00e4mningsans\u00f6kan m\u00e5ste anges <strong>tydligt<\/strong>.
