K\u00e4randen inleder en r\u00e4tteg\u00e5ng med p\u00e5st\u00e5endet att fastst\u00e4llelsen som gjorts under den katastrala best\u00e4mningen <strong>inte \u00e4r korrekt<\/strong> (att \u00e4garen felaktigt identifierats, att fastighetens yta felaktigt fastst\u00e4llts, etc.).<\/p>\n<p><strong>Exempel:<\/strong> Om en person m\u00e4rker att en mark som han tror tillh\u00f6r honom har fastst\u00e4llts som tillh\u00f6rande hans granne, kan han inleda en <strong>inv\u00e4ndningsprocess<\/strong> mot denna fastst\u00e4llelse.<\/p>\n<p>Parterna i r\u00e4tteg\u00e5ngen ska vara f\u00f6ljande:<\/p>\n<ul>\n<li><strong>K\u00e4rande:<\/strong> Personen som g\u00f6r inv\u00e4ndningar mot fastst\u00e4llelsen<\/li>\n<li><strong>Svarande:<\/strong> Den fastst\u00e4llda \u00e4garen (om avliden, hans <strong>arvingar<\/strong>)<\/li>\n<\/ul>\n<p><strong>Undantag:<\/strong> Om den fastst\u00e4llda \u00e4garen inte kan identifieras, utses enligt Lag nr. 3561 den <strong>h\u00f6gsta lokala finansiella tj\u00e4nstemannen<\/strong> som f\u00f6rvaltare, och r\u00e4tteg\u00e5ngen inleds mot denna f\u00f6rvaltare.<\/p>\n<p>I avg\u00f6randet fr\u00e5n <strong>Kassationsdomstolens<\/strong> 16:e Civilkammare, \u00c4rende nr. 2016\/13240, Beslut nr. 2020\/128, fastslogs att &#8221;I r\u00e4tteg\u00e5ngar mot katastral fastst\u00e4llelse ska r\u00e4tteg\u00e5ngen riktas till de fastst\u00e4llda \u00e4garna, och om de fastst\u00e4llda \u00e4garna \u00e4r avlidna, till deras arvingar, och <strong>alla arvingar m\u00e5ste inkluderas i r\u00e4tteg\u00e5ngen<\/strong>. Att s\u00e4kerst\u00e4lla parternas bildande \u00e4r en <strong>f\u00f6ruts\u00e4ttning f\u00f6r r\u00e4tteg\u00e5ngen<\/strong>, och sakens inneh\u00e5ll kan inte behandlas utan att denna f\u00f6ruts\u00e4ttning uppfylls.&#8221;<\/p>\n<h3>Insamling och Utv\u00e4rdering av Bevis<\/h3>\n<p>I r\u00e4tteg\u00e5ngar mot katastral fastst\u00e4llelse \u00e4r <strong>insamling och utv\u00e4rdering av bevis<\/strong> av stor betydelse. Domstolen samlar in och unders\u00f6ker f\u00f6ljande bevis:<\/p>\n<ul>\n<li><strong>Ursprungliga katastrala registreringar<\/strong><\/li>\n<li>Certifierade kopior av katastrala fastst\u00e4llelseregistreringar fr\u00e5n n\u00e4rliggande fastigheter<\/li>\n<li>Katastrala registreringar eller <strong>skatteregistreringar<\/strong> som k\u00e4randen \u00e5beropar<\/li>\n<li>Bevis avseende <strong>besittningsanspr\u00e5k<\/strong>, om s\u00e5dana finns<\/li>\n<li><strong>Arvscertifikat<\/strong> (om n\u00f6dv\u00e4ndigt)<\/li>\n<li><strong>Handlingar<\/strong> (inneh\u00e5llande k\u00f6p, donation, etc.)<\/li>\n<\/ul>\n<p><strong>Uppm\u00e4rksamhetspunkt:<\/strong> Domstolen samlar in bevis <strong>ex officio<\/strong>. S\u00e4rskilt i fall d\u00e4r \u00e4garkolumnen l\u00e4mnats tom (<strong>Turkiska katasterlagen<\/strong> nr. 3402, Artiklarna 10 och 27), \u00e4r katasterdomaren skyldig att skapa ett register och m\u00e5ste <strong>sj\u00e4lv samla in bevis<\/strong>.<\/p>\n<h3>F\u00e4ltunders\u00f6kning och Expertunders\u00f6kning<\/h3>\n<p>I r\u00e4tteg\u00e5ngar mot katastral fastst\u00e4llelse \u00e4r det <strong>obligatoriskt<\/strong> att utf\u00f6ra en <strong>f\u00e4ltunders\u00f6kning<\/strong> och en <strong>expertunders\u00f6kning<\/strong>. Punkterna som ska beaktas under f\u00e4ltunders\u00f6kningen \u00e4r f\u00f6ljande:<\/p>\n<ul>\n<li><strong>Till\u00e4mpning av katastrala registreringar:<\/strong> Om det finns en katastral registrering som man f\u00f6rlitar sig p\u00e5, ska denna registrering till\u00e4mpas enligt den i lagen skrivna proceduren. Om det finns en <strong>karta, plan och skiss<\/strong> av registreringen, ska till\u00e4mpningen g\u00f6ras i enlighet med <strong>Artikel 20\/A i Lag nr. 3402<\/strong>.<\/li>\n<li><strong>Till\u00e4mpning av skatteregistreringar:<\/strong> Om man f\u00f6rlitar sig p\u00e5 skatteregistreringar, ska varje gr\u00e4ns som st\u00e5r i registreringen efterfr\u00e5gas och fastst\u00e4llas.<\/li>\n<li><strong>Besittningsunders\u00f6kning:<\/strong> Om det finns ett besittningsanspr\u00e5k, ska besittning fr\u00e5n <strong>20-\u00e5rsperioden<\/strong> f\u00f6re den katastrala fastst\u00e4llelsen unders\u00f6kas.<\/li>\n<li><strong>F\u00f6rklaringar fr\u00e5n experter och vittnen:<\/strong> Lokala experter och vittnen ska h\u00f6ras <strong>p\u00e5 fastighetens plats<\/strong>.<\/li>\n<\/ul>\n<p><strong>Exempel:<\/strong> Som n\u00e4mnt i avg\u00f6randet fr\u00e5n <strong>Turkiska kassationsdomstolens<\/strong> 16:e Civilkammare, \u00c4rende nr. 2016\/16910, Beslut nr. 2020\/773, &#8221;P\u00e5 grund av att r\u00e4tteg\u00e5ngen g\u00e4ller sj\u00e4lva egendomen, <strong>borde vittnen ha h\u00f6rts p\u00e5 fastighetens plats<\/strong>, men deras f\u00f6rklaringar togs emot i strid med proceduren under f\u00f6rhandlingen.&#8221;<\/p>\n<ul>\n<li><strong>Teknisk expertrapport:<\/strong> En rapport som \u00e4r l\u00e4mplig f\u00f6r \u00f6vervakning och \u00f6verinseende av f\u00e4ltunders\u00f6kningen m\u00e5ste erh\u00e5llas.<\/li>\n<\/ul>\n<p><strong>Undantag:<\/strong> Vid tvister ang\u00e5ende <strong>platser f\u00f6r allm\u00e4nt bruk<\/strong> som betesmarker och plat\u00e5er, ska <strong>lokala experter som \u00e4r s\u00e5 gamla som m\u00f6jligt och opartiska<\/strong>, bosatta i n\u00e4rliggande byar, h\u00f6ras ang\u00e5ende besittningsfr\u00e5gan.<\/p>\n<h3>Speciella Situationer och Uppm\u00e4rksamhetspunkter<\/h3>\n<p>1. <strong>F\u00f6rv\u00e4rv Via Icke-\u00c4gandev\u00e4gar:<\/strong> Artikel 13\/B-b i <strong>Turkiska katasterlagen<\/strong> nr. 3402 erk\u00e4nner v\u00e4rdet av <strong>obestridd, kontinuerlig besittning i egenskap av \u00e4gare<\/strong> f\u00f6r de som f\u00f6rv\u00e4rvat egendom externt via icke-\u00e4gandev\u00e4gar.<\/p>\n<p><strong>Exempel:<\/strong> I avg\u00f6randet fr\u00e5n Kassationsdomstolens 16:e Civilkammare, \u00c4rende nr. 2015\/19171, Beslut nr. 2018\/452, fastslogs att &#8221;Det fastst\u00e4lldes att k\u00e4randen Mustafa Sezer <strong>var i besittning av den omtvistade delen av egendomen fr\u00e5n dagen f\u00f6r fastst\u00e4llelse genom arv och delning fr\u00e5n sin arvl\u00e5tare<\/strong>, och villkoren i Artikel 13\/B-b i Lag nr. 3402 uppfylldes till hans f\u00f6rdel.&#8221;<\/p>\n<p>2. <strong>Delningsanspr\u00e5k:<\/strong> Om det finns ett anspr\u00e5k att egendomar som \u00e4rvts fr\u00e5n en gemensam arvl\u00e5tare har delats, ska det unders\u00f6kas om <strong>egendom har tilldelats alla arvingar<\/strong> genom delning och om <strong>alla arvingar har deltagit<\/strong> i delningen.<\/p>\n<p>3. <strong>Tvister om Betesmarker och Plat\u00e5er:<\/strong> \u00c4gandet av s\u00e5dana egendomar tillh\u00f6r <strong>Statskassan<\/strong>, medan <strong>nyttjander\u00e4tten<\/strong> tillh\u00f6r by- eller stadsborna. R\u00e4tteg\u00e5ngar ska riktas till b\u00e5de Statskassan, som \u00e4r \u00e4gare av \u00e4gander\u00e4tten, och till den <strong>offentligr\u00e4ttsliga enheten<\/strong> som har nyttjander\u00e4tten.<\/p>\n<p><strong>Uppm\u00e4rksamhetspunkt:<\/strong> Enligt Lag nr. 6360 \u00e4r det obligatoriskt f\u00f6r egendomar inom storstadskommunernas gr\u00e4nser att inkludera <strong>distriktskommun och storstadskommun<\/strong> i r\u00e4tteg\u00e5ngen.<\/p>\n<p>4. <strong>Markomf\u00f6rdelningsarbeten Enligt Lag nr. 4753:<\/strong> I s\u00e5dana r\u00e4tteg\u00e5ngar ska <strong>f\u00f6rdelningskartor l\u00e4ggas \u00f6ver den katastrala kartan<\/strong> och till\u00e4mpas p\u00e5 marken, varvid det best\u00e4ms om egendomen var f\u00f6rem\u00e5l f\u00f6r delning som f\u00f6ljd av tilldelningen.<\/p>\n<p>5. <strong>Platser Som Inte Kan F\u00f6rv\u00e4rvas Genom Besittning:<\/strong> Det ska beaktas att <strong>betesmarker, plat\u00e5er, vinterkvarter, skogar, str\u00f6mmar, floder och gamla v\u00e4gar under Statens myndighet och f\u00f6rfogande, kulturell-naturliga tillg\u00e5ngar, klippiga, steniga, buskiga egendomar, stenbrott, bryggor och gediks, egendomar inom kustlinjen inte kan vara f\u00f6rem\u00e5l f\u00f6r privat \u00e4gander\u00e4tt<\/strong>.<\/p>\n<h3>Uttalande av domen och meddelande om beslutet<\/h3>\n<p>Domstolen kommer fram till ett beslut genom att utv\u00e4rdera alla insamlade bevis.<br \/>\nDe punkter som m\u00e5ste beaktas vid uttalande av domen \u00e4r f\u00f6ljande:<\/p>\n<ul>\n<li>Det m\u00e5ste skapas ett <strong>tydligt och verkst\u00e4llbart register<\/strong>.<\/li>\n<li>I domen m\u00e5ste det <strong>entydigt<\/strong> anges f\u00f6r vem eller vilka personer och med vilka andelar \u00e4gandet beslutas att registreras.<\/li>\n<li>Ett <strong>beslut m\u00e5ste fattas<\/strong> och ett register skapas f\u00f6r alla fastigheter som \u00e4r f\u00f6rem\u00e5l f\u00f6r r\u00e4tteg\u00e5ngen.<\/li>\n<\/ul>\n<p><strong>Exempel:<\/strong> Som n\u00e4mnts i beslutet fr\u00e5n 16:e Civilkammaren vid <strong>Turkiska Kassationsdomstolen<\/strong>, \u00c4rende nr. 2016\/17949, Beslut nr. 2020\/1689, f\u00f6r fastigheter av <strong>allm\u00e4n anv\u00e4ndning<\/strong> som betesmarker och plat\u00e5er, m\u00e5ste beslutet fattas som &#8221;den omtvistade fastigheten m\u00e5ste avgr\u00e4nsas och registreras i sitt s\u00e4rskilda register som betesmark i enlighet med Artikel 16\/B i <strong>Turkisk lag<\/strong> nr. 3402.&#8221;<br \/>\nDet <strong>slutgiltiga beslutet<\/strong> m\u00e5ste vederb\u00f6rligen meddelas alla parter i r\u00e4tteg\u00e5ngen. Fel som beg\u00e5s av posttj\u00e4nstem\u00e4n vid till\u00e4mpningen av Artikel 10 och Artiklarna 21\/1 och 21\/2 i Lag nr. 7201 m\u00e5ste <strong>\u00f6vervakas<\/strong> av domaren vid domstolen.<\/p>\n<h2>Slutsats<\/h2>\n<p>R\u00e4tteg\u00e5ngen mot <strong>katasterfastst\u00e4llelse<\/strong> \u00e4r en viktig del av fastighetsr\u00e4tten i <strong>Turkiet<\/strong>. Korrekt genomf\u00f6rande av dessa r\u00e4tteg\u00e5ngar \u00e4r av stor betydelse n\u00e4r det g\u00e4ller att <strong>skydda \u00e4gander\u00e4tt<\/strong> och skapa ett sunt katasterregister.
