Artikel 35 i den turkiska konstitutionen garanterar \u00e4gander\u00e4tten, medan artikel 46 fastst\u00e4ller ramen inom vilken denna r\u00e4tt kan begr\u00e4nsas genom expropriation. Dessa tv\u00e5 best\u00e4mmelser \u00e5terspeglar en omsorgsfullt uppr\u00e4tth\u00e5llen balans mellan individuella \u00e4gander\u00e4tter och kollektiva allm\u00e4nna intressen.<\/p>\n<p>F\u00f6r utl\u00e4ndska medborgare som \u00e4ger fastigheter i Turkiet \u00e4r det av avg\u00f6rande betydelse att f\u00f6rst\u00e5 hur expropriation fungerar. Turkiet till\u00e5ter utl\u00e4nningar att f\u00f6rv\u00e4rva fast egendom enligt lag nr 2644 (lagfartslagen), och de som g\u00f6r det omfattas av samma expropriationsregler som turkiska medborgare. Den till\u00e4mpliga lagstiftningen \u00e4r expropriationslagen nr 2942, som fastst\u00e4ller villkor, f\u00f6rfaranden, ers\u00e4ttningsmekanismer och r\u00e4ttsliga r\u00e4ttsmedel f\u00f6r alla fastighets\u00e4gare oavsett nationalitet.<\/p>\n<h2>R\u00e4ttsliga F\u00f6ruts\u00e4ttningar f\u00f6r en Giltig Expropriation<\/h2>\n<p>Inte varje statligt beslut om att ta egendom i anspr\u00e5k utg\u00f6r en laglig expropriation. Turkisk lag uppst\u00e4ller strikta f\u00f6ruts\u00e4ttningar som alla m\u00e5ste vara uppfyllda innan f\u00f6rfarandet kan inledas. F\u00f6r det fj\u00e4rde m\u00e5ste tillr\u00e4ckliga budgetanslag finnas innan expropriationsf\u00f6rfarandet inleds, vilket s\u00e4kerst\u00e4ller att fastighets\u00e4gare inte l\u00e4mnas utan ers\u00e4ttning p\u00e5 grund av finansiella begr\u00e4nsningar.<\/p>\n<h2>Fastst\u00e4llande av Sk\u00e4lig Ers\u00e4ttning<\/h2>\n<p>Den turkiska konstitutionen f\u00f6reskriver att den exproprierade egendomens &#8221;verkliga motsvarighet&#8221; ska betalas i f\u00f6rskott. Detta krav \u00e4r inte enbart av processuell natur \u2014 det \u00e4r en grundl\u00e4ggande garanti f\u00f6r \u00e4gander\u00e4tten. Det verkliga motv\u00e4rdet avser fastighetens marknadsv\u00e4rde, inte ett administrativt fastst\u00e4llt v\u00e4rde s\u00e5som kommunala taxeringsv\u00e4rden, som ofta ligger l\u00e5ngt under det faktiska marknadsv\u00e4rdet.<\/p>\n<p>V\u00e4rderingen utf\u00f6rs av sakkunniga som beaktar en rad objektiva kriterier. F\u00f6r jordbruksmark anv\u00e4nds nettoavkastningsber\u00e4kningar. F\u00f6r stadstomter utg\u00f6r j\u00e4mf\u00f6rbara f\u00f6rs\u00e4ljningsdata i n\u00e4rheten det prim\u00e4ra riktm\u00e4rket. F\u00f6r byggnader och anl\u00e4ggningar till\u00e4mpas officiella enhetsbyggkostnader justerade f\u00f6r v\u00e4rdeminskning. Det \u00e4r avg\u00f6rande att eventuell v\u00e4rde\u00f6kning som uppst\u00e5r till f\u00f6ljd av det offentliga projekt som n\u00f6dv\u00e4ndigg\u00f6r expropriationen undantas fr\u00e5n ers\u00e4ttningsber\u00e4kningen \u2014 \u00e4gare ers\u00e4tts f\u00f6r det v\u00e4rde deras fastighet hade oberoende av statens ingripande.<\/p>\n<p>Konstitutionen f\u00f6reskriver f\u00f6rskottsbetalning som huvudregel men till\u00e5ter \u00e4ven avbetalning i vissa kategorier av offentliga projekt. <em>Artikel 46 i konstitutionen f\u00f6reskriver att vid jordreform, storskaliga energi- och bevattningsprojekt, bos\u00e4ttningsprogram, nyplantering av skog, kustskydd och turistrelaterad expropriation f\u00e5r ers\u00e4ttningen betalas i h\u00f6gst fem lika stora \u00e5rliga delbetalningar, med till\u00e4mpning av den h\u00f6gsta r\u00e4ntesatsen f\u00f6r statsobligationer.<\/em> Sm\u00e5brukare som personligen brukar sin mark m\u00e5ste alltid erh\u00e5lla full f\u00f6rskottsbetalning oavsett projekttyp.<\/p>\n<h2>Expropriationsf\u00f6rfarandet: Administrativa och R\u00e4ttsliga Faser<\/h2>\n<p>Expropriationsf\u00f6rfarandet i Turkiet genomf\u00f6rs i tv\u00e5 huvudfaser. Den administrativa fasen inleds med tilldelning av n\u00f6dv\u00e4ndiga budgetmedel och antagande av beslutet om allm\u00e4nt intresse. N\u00e4r dessa f\u00f6ruts\u00e4ttningar \u00e4r uppfyllda identifieras fastigheten och dess \u00e4gare, ett formellt expropriationsbeslut fattas och en anteckning g\u00f6rs i fastighetsregistret f\u00f6r att f\u00f6rhindra att fastigheten \u00f6verl\u00e5ts under mellantiden.<\/p>\n<p>Innan r\u00e4ttsliga f\u00f6rfaranden inleds \u00e4r f\u00f6rvaltningen lagligen skyldig att f\u00f6rs\u00f6ka genomf\u00f6ra ett f\u00f6rhandlat k\u00f6p. En v\u00e4rderingskommission fastst\u00e4ller det uppskattade marknadsv\u00e4rdet p\u00e5 fastigheten, och en separat f\u00f6rhandlingskommission f\u00f6r sedan diskussioner med \u00e4garen i syfte att n\u00e5 en uppg\u00f6relse. Om b\u00e5da parter n\u00e5r en \u00f6verenskommelse l\u00f6ses \u00e4rendet utan r\u00e4ttstvist och \u00e4garen f\u00f6rlorar r\u00e4tten att i efterhand ifr\u00e5gas\u00e4tta ers\u00e4ttningsbeloppet. Denna f\u00f6rhandlingsfas \u00e4r inte frivillig \u2014 det \u00e4r ett obligatoriskt steg som erbjuder b\u00e5da parter en snabbare och mindre konfliktfylld l\u00f6sning.<\/p>\n<p>Om ingen \u00f6verenskommelse n\u00e5s inleds den r\u00e4ttsliga fasen. F\u00f6rvaltningen v\u00e4cker talan vid den beh\u00f6riga tingsr\u00e4tten (Asliye Hukuk Mahkemesi) i det omr\u00e5de d\u00e4r fastigheten \u00e4r bel\u00e4gen, med yrkande om domstolsfastst\u00e4lld v\u00e4rdering och registrering av fastigheten i statens namn. Domstolen uppmanar f\u00f6rst b\u00e5da parter att f\u00f6rs\u00f6ka n\u00e5 f\u00f6rlikning. Om detta misslyckas f\u00f6rordnar domstolen en besiktning p\u00e5 plats och utser oberoende sakkunniga f\u00f6r att v\u00e4rdera fastigheten enligt de lagstadgade kriterierna. Domstolen meddelar d\u00e4refter en dom som fastst\u00e4ller ers\u00e4ttningsbeloppet.<\/p>\n<p>N\u00e4r den domstolsfastst\u00e4llda ers\u00e4ttningen har satts in p\u00e5 ett bankkonto i \u00e4garens namn f\u00f6rordnar domstolen om \u00f6verf\u00f6ring av \u00e4gander\u00e4tten till staten. Domen avseende \u00e4gander\u00e4tts\u00f6verg\u00e5ngen \u00e4r slutgiltig och kan inte \u00f6verklagas. \u00c4garen kan dock \u00f6verklaga ers\u00e4ttningsbeloppet till appellationsdomstolen (\u0130stinaf) och H\u00f6gsta domstolen (Yarg\u0131tay), vilket inneb\u00e4r att tvisten om v\u00e4rdet kan forts\u00e4tta utan att statens anv\u00e4ndning av fastigheten f\u00f6rdr\u00f6js.<\/p>\n<p>Fastighets\u00e4gare som erh\u00e5ller underr\u00e4ttelse om expropriationsf\u00f6rfaranden har trettio dagar fr\u00e5n underr\u00e4ttelsedatumet p\u00e5 sig att v\u00e4cka talan i f\u00f6rvaltningsdomstol om ogiltigf\u00f6rklaring av expropriationsbeslutet. Om f\u00f6rvaltningsdomstolen beviljar inhibition vilandef\u00f6rklaras det civila f\u00f6rfarandet. Om ogiltighetstalan bifalls l\u00e4ggs det civila m\u00e5let ned i sin helhet. Detta dubbla r\u00e4ttsskydd \u2014 f\u00f6rvaltningsr\u00e4ttslig pr\u00f6vning av lagligheten och civilr\u00e4ttslig pr\u00f6vning av v\u00e4rderingen \u2014 s\u00e4kerst\u00e4ller en effektiv tillsyn \u00f6ver expropriationsf\u00f6rfarandet.<\/p>\n<h2>R\u00e4tten att \u00c5terf\u00e5 Expropriad Egendom<\/h2>\n<p>Turkisk lag tillerk\u00e4nner tidigare \u00e4gare en \u00e5tervinningsr\u00e4tt under specifika omst\u00e4ndigheter. Om staten inom fem \u00e5r fr\u00e5n det att ers\u00e4ttningen vunnit laga kraft inte har vidtagit n\u00e5gon \u00e5tg\u00e4rd i enlighet med det deklarerade allm\u00e4nnyttiga syftet eller har l\u00e4mnat fastigheten outnyttjad, kan den tidigare \u00e4garen \u00e5terf\u00e5 den genom att \u00e5terbetala erh\u00e5llen ers\u00e4ttning j\u00e4mte upplupen r\u00e4nta. Denna r\u00e4tt m\u00e5ste ut\u00f6vas inom ett \u00e5r fr\u00e5n det att fem\u00e5rsperioden l\u00f6per ut. \u00c5tervinningsmekanismen fungerar som ett avskr\u00e4ckningsmedel mot att expropriation anv\u00e4nds f\u00f6r andra \u00e4ndam\u00e5l \u00e4n genuint allm\u00e4nintresse.<\/p>\n<h2>Olagligt Tagande Utan Expropriationsf\u00f6rfarande<\/h2>\n<p>En s\u00e4rskild men viktig fr\u00e5ga uppst\u00e5r n\u00e4r staten faktiskt eller r\u00e4ttsligt tar privat egendom i besittning utan att f\u00f6lja det formella expropriationsf\u00f6rfarandet. I s\u00e5dana fall \u00e4r \u00e4garen inte utan r\u00e4ttsmedel. Turkiska domstolar erk\u00e4nner anspr\u00e5k p\u00e5 betalning av fastighetens fulla v\u00e4rde, anspr\u00e5k p\u00e5 upph\u00f6rande av olagliga ingrepp samt anspr\u00e5k p\u00e5 ers\u00e4ttning motsvarande f\u00f6rlorade int\u00e4kter under den obeh\u00f6riga nyttjandeperioden. Det finns ingen preskriptionstid till\u00e4mplig p\u00e5 det huvudsakliga ers\u00e4ttningsanspr\u00e5ket \u2014 konstitutionsdomstolen har ogiltigf\u00f6rklarat varje best\u00e4mmelse som inf\u00f6r en preklusionsfrist i detta avseende \u2014 \u00e4ven om anspr\u00e5k p\u00e5 f\u00f6rlorade int\u00e4kter enligt fast r\u00e4ttspraxis i allm\u00e4nhet begr\u00e4nsas till fem \u00e5r.<\/p>\n<h2>R\u00e4ttslig Kontroll och Konstitutionella Garantier<\/h2>\n<p>Turkiets konstitutionsdomstol har slagit fast att \u00f6verg\u00e5ng av \u00e4gander\u00e4tten till staten innan ers\u00e4ttningen slutgiltigt fastst\u00e4llts och till fullo utbetalats utg\u00f6r en kr\u00e4nkning av \u00e4gander\u00e4tten. Detta avg\u00f6rande st\u00e4rker principen om f\u00f6rskottsbetalning och \u00e5l\u00e4gger domstolarna att s\u00e4kerst\u00e4lla att ers\u00e4ttningen inte enbart utlovas utan faktiskt mottas innan \u00e4gander\u00e4tts\u00f6verg\u00e5ngen sker. Presidentens beslut om akut expropriation (Acele Kamula\u015ft\u0131rma) \u00e4r f\u00f6rem\u00e5l f\u00f6r pr\u00f6vning av Statsr\u00e5det (Dan\u0131\u015ftay), som granskar huruvida en verklig n\u00f6dsituation f\u00f6religger och om allm\u00e4nintresset konkret har p\u00e5visats.
