Hyresg\u00e4st- och hyresv\u00e4rdrelationen i Turkiet regleras prim\u00e4rt av den turkiska obligationslagen (T\u00fcrk Bor\u00e7lar Kanunu, TBK) nr 6098, s\u00e4rskilt artiklarna 299 till 355, som fastst\u00e4ller det r\u00e4ttsliga ramverket f\u00f6r hyresavtal, r\u00e4ttigheter och skyldigheter f\u00f6r b\u00e5da parter. Det turkiska r\u00e4ttssystemet betraktas i allm\u00e4nhet som hyresg\u00e4stsv\u00e4nligt och erbjuder l\u00e5ngsiktigt skydd mot vr\u00e4kning och godtyckliga hyresh\u00f6jningar.<\/p>\n<h2>Hyresavtalet: Skriftligt eller Muntligt?<\/h2>\n<p>Hyresavtal i Turkiet kan ing\u00e5s antingen skriftligt eller muntligt, och b\u00e5da formerna \u00e4r juridiskt giltiga. Ett skriftligt avtal rekommenderas dock starkt eftersom det utg\u00f6r tydlig bevisning vid eventuella tvister. Den turkiska obligationslagen skyddar hyresg\u00e4ster under b\u00e5da avtalstyperna och s\u00e4kerst\u00e4ller att r\u00e4ttigheterna kvarst\u00e5r oavsett avtalets form. Ett standardhyresavtal l\u00f6per vanligtvis p\u00e5 ett \u00e5r och f\u00f6rl\u00e4ngs automatiskt om ingen av parterna meddelar upps\u00e4gning i tid. Denna mekanism f\u00f6r automatisk f\u00f6rl\u00e4ngning \u00e4r ett av de grundl\u00e4ggande skydden f\u00f6r hyresg\u00e4ster, eftersom det hindrar hyresv\u00e4rdar fr\u00e5n att helt enkelt avsluta ett hyresf\u00f6rh\u00e5llande vid kontraktsperiodens slut utan r\u00e4ttslig grund.<\/p>\n<p>Den r\u00e4ttsliga definitionen av ett hyresavtal \u00e4r tydligt fastst\u00e4lld i lag. Artikel 299 i den turkiska obligationslagen definierar hyresv\u00e4rden som den part som \u00e5tar sig att \u00f6verl\u00e5ta nyttjandet eller avkastningen av en hyrd egendom till hyresg\u00e4sten mot en best\u00e4md ers\u00e4ttning. D\u00e4rut\u00f6ver f\u00f6rpliktar Artikel 301 hyresv\u00e4rdar att underh\u00e5lla fastigheten i ett skick som \u00e4r l\u00e4mpligt f\u00f6r dess avsedda \u00e4ndam\u00e5l och att utf\u00f6ra n\u00f6dv\u00e4ndiga reparationer, s\u00e5vida inte skadan orsakats av hyresg\u00e4stens egna handlingar.<\/p>\n<h2>Skydd Mot Hyresh\u00f6jningar<\/h2>\n<p>Ett av de mest praktiskt betydelsefulla skydden f\u00f6r hyresg\u00e4ster i turkisk r\u00e4tt r\u00f6r hur hyran f\u00e5r h\u00f6jas. Hyresh\u00f6jningar i Turkiet regleras av den turkiska obligationslagen nr 6098 och tillh\u00f6rande lagstiftning. F\u00f6r bostadshyra ber\u00e4knas hyresh\u00f6jningen utifr\u00e5n konsumentprisindex (KPI) som offentligg\u00f6rs av det turkiska statistikinstitutet (T\u00dc\u0130K).<\/p>\n<p>Den till\u00e4mpliga lagbest\u00e4mmelsen lyder som f\u00f6ljer:<\/p>\n<p><em>Artikel 344 i den turkiska obligationslagen \u2013 \u00d6verenskommelser mellan parterna om det hyrespris som ska g\u00e4lla f\u00f6r f\u00f6rl\u00e4ngda hyresperioder \u00e4r giltiga, f\u00f6rutsatt att f\u00f6r\u00e4ndringsprocenten inte \u00f6verstiger tolvm\u00e5nadersgenomsnittet av konsumentprisindex f\u00f6r det f\u00f6reg\u00e5ende hyres\u00e5ret.<\/em><\/p>\n<p>Enligt lag f\u00e5r hyran h\u00f6jas endast en g\u00e5ng per \u00e5r och enbart vid f\u00f6rl\u00e4ngningen av hyresavtalet. Om en hyresv\u00e4rd kr\u00e4ver en h\u00f6gre hyresh\u00f6jning \u00e4n det lagstadgade taket \u00e4r hyresg\u00e4sten inte skyldig att acceptera detta. Vid tvister kan hyresg\u00e4sten v\u00e4cka talan vid hyresn\u00e4mnden f\u00f6r att h\u00e4vda sina r\u00e4ttigheter. Det \u00e4r ocks\u00e5 v\u00e4rt att notera att hyresv\u00e4rd och hyresg\u00e4st kan komma \u00f6verens om ett l\u00e4gre h\u00f6jningsbelopp om b\u00e5da parter samtycker till detta inom KPI-ramverket.<\/p>\n<p>Historiskt sett begr\u00e4nsade en tillf\u00e4llig regerings\u00e5tg\u00e4rd bostadshyresh\u00f6jningarna till 25 procent under perioden juni 2022 till juli 2024. Denna begr\u00e4nsning upph\u00f6rde den 1 juli 2024 och h\u00f6jningar ber\u00e4knas sedan dess enbart utifr\u00e5n inflationen enligt KPI. \u00c4ven om denna specifika gr\u00e4ns har upph\u00f6rt att g\u00e4lla forts\u00e4tter KPI-regeln att skydda hyresg\u00e4ster mot orimliga h\u00f6jningar.<\/p>\n<h2>R\u00e4ttigheter Avseende Depositionskravet<\/h2>\n<p>Hyresv\u00e4rdar i Turkiet f\u00e5r beg\u00e4ra en depositionsavgift, men detta belopp f\u00e5r inte \u00f6verstiga tre m\u00e5naders hyra. Hanteringen av denna deposition regleras ocks\u00e5 av lag. Enligt turkisk r\u00e4tt ska depositionen placeras p\u00e5 ett tidsbundet konto som hyresv\u00e4rden \u00f6ppnar i hyresg\u00e4stens namn. Om depositionen betalas kontant m\u00e5ste den h\u00e5llas p\u00e5 ett bankkonto och generera r\u00e4nta. Den kan endast \u00e5terbetalas med \u00f6msesidigt samtycke eller efter ett lagakraftvunnet domstolsbeslut.<\/p>\n<p>Hyresv\u00e4rden \u00e4r skyldig att \u00e5terbetala depositionen vid hyresperiodens slut, f\u00f6rutsatt att fastigheten \u00e4r i gott skick. Vid eventuella tvister m\u00e5ste hyresv\u00e4rden l\u00e4gga fram bevis f\u00f6r att motivera ett inneh\u00e5llande av depositionen. I fall d\u00e4r en hyresv\u00e4rd utan giltig anledning v\u00e4grar \u00e5terbetala depositionen har hyresg\u00e4sten r\u00e4tt att s\u00f6ka l\u00f6sning genom medling eller domstol.<\/p>\n<h2>Skydd Mot Olaglig Vr\u00e4kning<\/h2>\n<p>Turkisk r\u00e4tt ger ett robust skydd mot obefogad vr\u00e4kning. En hyresg\u00e4st kan inte godtyckligt vr\u00e4kas \u00e4ven om kontraktsperioden har l\u00f6pt ut. Hyresv\u00e4rdens r\u00e4tt att vr\u00e4ka m\u00e5ste grundas p\u00e5 ber\u00e4ttigade och konkreta sk\u00e4l som tydligt anges i lagen, s\u00e5som personligt behov, rivning, ett skriftligt \u00e5tagande om att l\u00e4mna bostaden eller hyresg\u00e4stens underl\u00e5tenhet att betala hyra.<\/p>\n<p>Artikel 352 i den turkiska obligationslagen fastst\u00e4ller att en hyresv\u00e4rd m\u00e5ste l\u00e4mna skriftlig upps\u00e4gning minst tre m\u00e5nader f\u00f6re hyresperiodens utg\u00e5ng om hyresf\u00f6rh\u00e5llandet grundar sig p\u00e5 ett skriftligt tidsbegr\u00e4nsat avtal. F\u00f6r avtal p\u00e5 obest\u00e4md tid g\u00e4ller ocks\u00e5 en upps\u00e4gningstid p\u00e5 minst tre m\u00e5nader.<\/p>\n<p>En hyresv\u00e4rd kan inte vr\u00e4ka en hyresg\u00e4st enbart p\u00e5 grund av att hyresavtalet har l\u00f6pt ut. Hyresv\u00e4rden m\u00e5ste \u00e5beropa ett lagstadgat sk\u00e4l eller v\u00e4nta till det tionde f\u00f6rl\u00e4ngnings\u00e5ret vid bostadshyra eller hyra av en \u00f6verd\u00e4ckt arbetslokal. Om hyresv\u00e4rden s\u00e4ljer fastigheten forts\u00e4tter hyresavtalet p\u00e5 samma villkor med den nya \u00e4garen. F\u00f6rs\u00e4ljningen av fastigheten avslutar inte hyresavtalet.<\/p>\n<h2>Underh\u00e5ll, Reparationer och Fastighetskostnader<\/h2>\n<p>Kostnader som inte \u00e4r direkt kopplade till hyresg\u00e4stens anv\u00e4ndning av fastigheten \u00e4r hyresv\u00e4rdens ansvar. Om hyresg\u00e4sten \u00e4nd\u00e5 betalar dessa kostnader har denne r\u00e4tt att dra av dem fr\u00e5n hyresbetalningarna. Exempelvis \u00e4r ytterm\u00e5lning av en l\u00e4genhet \u00e4garens ansvar, \u00e4ven om parterna kan avtala om annat i kontraktet. Om det finns brister i fastigheten innan hyresg\u00e4sten tilltr\u00e4der kan hyresg\u00e4sten kr\u00e4va att hyresv\u00e4rden utf\u00f6r underh\u00e5ll och reparationer. Alternativt kan hyresg\u00e4sten samtycka till att sj\u00e4lv st\u00e5 f\u00f6r reparationskostnaderna och dra av dessa fr\u00e5n kommande hyresbetalningar.<\/p>\n<p>Hyresg\u00e4ster ansvarar f\u00f6r brukskostnader direkt kopplade till deras anv\u00e4ndning av fastigheten, s\u00e5som vatten, el och naturgas. Stora strukturella reparationer, fastighetsskatt och obligatorisk jordb\u00e4vningsf\u00f6rs\u00e4kring \u00e4r d\u00e4remot hyresv\u00e4rdens ansvar.<\/p>\n<p>Turkisk hyresr\u00e4tt g\u00f6r ocks\u00e5 en tydlig \u00e5tskillnad mellan avsiktlig skada och normalt slitage. Det finns en distinktion mellan skador och den f\u00f6rv\u00e4ntade v\u00e4rdeminskning av en fastighet som uppst\u00e5r genom normalt nyttjande \u00f6ver tid. Hyresg\u00e4ster kan inte h\u00e5llas ansvariga f\u00f6r det senare, vilket ger dem skydd mot ober\u00e4ttigade krav.<\/p>\n<h2>Tvistl\u00f6sning<\/h2>\n<p>Vid en tvist mellan hyresg\u00e4st och hyresv\u00e4rd inneh\u00e5ller artiklarna 316 och 340 i den turkiska obligationslagen specifika f\u00f6rfaranden f\u00f6r att hantera vanliga konflikter, s\u00e5som utebliven hyresbetalning och skada p\u00e5 fastigheten. I s\u00e5dana fall fastst\u00e4ller domstolen hyresh\u00f6jningen utifr\u00e5n konsumentprisindex och reglerar hyresg\u00e4stens betalningsskyldigheter i enlighet med detta.<\/p>\n<h2>Utl\u00e4ndska Hyresg\u00e4sters R\u00e4ttigheter<\/h2>\n<p>Utl\u00e4ndska hyresg\u00e4sters r\u00e4ttigheter i Turkiet \u00e4r i stort sett desamma som de som beviljas turkiska medborgare enligt den turkiska obligationslagen. Hyresv\u00e4rdar f\u00e5r inte behandla hyresg\u00e4ster annorlunda p\u00e5 grund av nationalitet. Utl\u00e4ndska hyresg\u00e4ster \u00e4r r\u00e4ttsligt skyddade inom samma ramverk som lokala hyresg\u00e4ster. Utl\u00e4ndska inv\u00e5nare som hyr i Turkiet har r\u00e4tt till samma skydd avseende vr\u00e4kning, hyresh\u00f6jningar, \u00e5terbetalning av deposition och fastighetsunderh\u00e5ll som alla andra hyresg\u00e4ster.<\/p>\n<p>Det \u00e4r av stor vikt att hyresg\u00e4ster \u00e4r fullt informerade om sina r\u00e4ttigheter under det f\u00f6rcontraktuella stadiet, under avtalstiden och i samband med avflyttning, samt att de k\u00e4nner till de r\u00e4ttsliga \u00e5tg\u00e4rder som st\u00e5r till deras f\u00f6rfogande vid kr\u00e4nkning av dessa r\u00e4ttigheter.
