Denna skyldighet grundar sig p\u00e5 lagen om internationalisering av arbetskraft (lag nr 6735), som tr\u00e4dde i kraft den 13 augusti 2016. Lagen reglerar p\u00e5 ett systematiskt s\u00e4tt utl\u00e4ndska arbetstagares tilltr\u00e4de till den turkiska arbetsmarknaden och fastst\u00e4ller preciserade r\u00e4ttsliga krav f\u00f6r s\u00e5v\u00e4l arbetstagare som arbetsgivare. Att arbeta utan s\u00e5dant tillst\u00e5nd \u00e4r uttryckligen f\u00f6rbjudet enligt lag och medf\u00f6r administrativa sanktioner f\u00f6r b\u00e5da parter i arbetsf\u00f6rh\u00e5llandet.<\/p>\n<h2>R\u00e4ttslig Grund<\/h2>\n<p>Arbetstillst\u00e5ndet utf\u00e4rdas av ministeriet f\u00f6r arbete och social trygghet p\u00e5 grundval av den internationella arbetskraftspolitik som fastst\u00e4lls av beh\u00f6riga myndigheter. Artikel 10, f\u00f6rsta stycket, i lag nr 6735 f\u00f6reskriver:<\/p>\n<p><em>Om ans\u00f6kan bed\u00f6ms positivt beviljas utl\u00e4nningen ett arbetstillst\u00e5nd f\u00f6r en specifik befattning hos en best\u00e4md arbetsgivare eller institution, f\u00f6r en inledande period om h\u00f6gst ett \u00e5r, inom ramen f\u00f6r arbets- eller tj\u00e4nsteavtalets varaktighet.<\/em><\/p>\n<p>Arbetstillst\u00e5ndet har samtidigt r\u00e4ttsverkan som uppeh\u00e5llstillst\u00e5nd, vilket inneb\u00e4r att innehavare inte \u00e4r skyldiga att ans\u00f6ka om ett separat uppeh\u00e5llstillst\u00e5nd under arbetstillst\u00e5ndets giltighetstid. Detta utg\u00f6r en praktisk f\u00f6rdel av betydande relevans inom turkisk r\u00e4tt f\u00f6r utl\u00e4ndska arbetstagare.<\/p>\n<h2>Krav p\u00e5 Arbetsgivaren<\/h2>\n<p>Arbetsgivaren m\u00e5ste uppfylla en rad kriterier innan en ans\u00f6kan om arbetstillst\u00e5nd kan l\u00e4mnas in. F\u00f6retaget m\u00e5ste ha minst fem f\u00f6rs\u00e4krade turkiska medborgare anst\u00e4llda. F\u00f6r varje ytterligare utl\u00e4ndsk arbetstagare som anst\u00e4lls m\u00e5ste detta f\u00f6rh\u00e5llande uppr\u00e4tth\u00e5llas, vilket inneb\u00e4r att vid anst\u00e4llning av tv\u00e5 utl\u00e4ndska arbetstagare m\u00e5ste minst tio turkiska medborgare vara anst\u00e4llda. Om den utl\u00e4ndske arbetstagaren \u00e4ven \u00e4r del\u00e4gare i f\u00f6retaget m\u00e5ste detta krav vara uppfyllt under de senaste sex m\u00e5naderna av tillst\u00e5ndets f\u00f6rsta giltighetst\u00e5r.<\/p>\n<p>F\u00f6retaget m\u00e5ste dessutom ha ett inbetalt aktiekapital om minst 100 000 turkiska lira. Vid bed\u00f6mningen av ans\u00f6kan beaktas \u00e4ven arbetsgivarens finansiella stabilitet, inklusive nettooms\u00e4ttning och ekonomisk verksamhet. N\u00e4r arbetsgivarens nettooms\u00e4ttning under det senaste \u00e5ret uppg\u00e5r till eller \u00f6verstiger 50 000 000 turkiska lira till\u00e4mpas inte syssels\u00e4ttningskravet om fem turkiska arbetstagare per utl\u00e4nning f\u00f6r de f\u00f6rsta fem utl\u00e4ndska arbetstagarna.<\/p>\n<h2>Krav p\u00e5 den Utl\u00e4ndske Arbetstagaren<\/h2>\n<p>F\u00f6r den utl\u00e4ndske arbetstagaren g\u00e4ller specifika krav. N\u00e4r ans\u00f6kan l\u00e4mnas in inifr\u00e5n Turkiet m\u00e5ste den s\u00f6kande inneha ett giltigt uppeh\u00e5llstillst\u00e5nd med en \u00e5terst\u00e5ende giltighetstid om minst sex m\u00e5nader. Vid ans\u00f6kan fr\u00e5n utlandet ska den utl\u00e4ndske medborgaren v\u00e4nda sig till det turkiska konsulatet eller ambassaden i bos\u00e4ttnings- eller medborgarskapslandets, varefter arbetsgivaren anv\u00e4nder det erh\u00e5llna referensnumret f\u00f6r att l\u00e4mna in den officiella ans\u00f6kan hos ministeriet.<\/p>\n<p>Arbetstillst\u00e5ndet utf\u00e4rdas alltid f\u00f6r den specifika befattning och det specifika arbetsst\u00e4lle som ans\u00f6kan avser. Ett byte av arbetsgivare kr\u00e4ver d\u00e4rf\u00f6r en ny ans\u00f6kan. Den ers\u00e4ttning som ska betalas till den utl\u00e4ndske arbetstagaren m\u00e5ste motsvara de minimitr\u00f6sklar som fastst\u00e4llts f\u00f6r respektive yrkeskategori och bed\u00f6ms utifr\u00e5n den minimil\u00f6n som g\u00e4ller vid tidpunkten f\u00f6r ans\u00f6kan.<\/p>\n<p>F\u00f6r vissa sektorer kr\u00e4vs dessutom ett f\u00f6rhandsgodk\u00e4nnande fr\u00e5n ett beh\u00f6rigt fackministerium. Inom turkisk r\u00e4tt kr\u00e4vs f\u00f6r h\u00e4lso- och sjukv\u00e5rdstj\u00e4nster respektive utbildning godk\u00e4nnande fr\u00e5n h\u00e4lsoministeriet respektive ministeriet f\u00f6r nationell utbildning. F\u00f6r akademiska tj\u00e4nster vid institutioner f\u00f6r h\u00f6gre utbildning \u00e4r r\u00e5det f\u00f6r h\u00f6gre utbildning beh\u00f6rig myndighet.<\/p>\n<h2>Typer av Arbetstillst\u00e5nd<\/h2>\n<p>Turkisk r\u00e4tt skiljer mellan tre huvudtyper av arbetstillst\u00e5nd. Det tidsbegr\u00e4nsade arbetstillst\u00e5ndet utf\u00e4rdas f\u00f6r en inledande period om h\u00f6gst ett \u00e5r. Artikel 10, andra stycket, i lag nr 6735 f\u00f6reskriver:<\/p>\n<p><em>Om f\u00f6rnyelseans\u00f6kan bed\u00f6ms positivt beviljas utl\u00e4nningen, knuten till samma arbetsgivare, ett tillst\u00e5nd om h\u00f6gst tv\u00e5 \u00e5r vid den f\u00f6rsta f\u00f6rnyelsen; vid efterf\u00f6ljande f\u00f6rnyelser f\u00e5r tillst\u00e5ndets giltighetstid inte \u00f6verstiga tre \u00e5r.<\/em><\/p>\n<p>Det tidsobegr\u00e4nsade arbetstillst\u00e5ndet \u00e4r tillg\u00e4ngligt f\u00f6r utl\u00e4nningar som innehar ett l\u00e5ngvarigt uppeh\u00e5llstillst\u00e5nd eller som lagligen har arbetat i Turkiet i minst \u00e5tta \u00e5r. Artikel 10, tredje stycket, preciserar dock att uppfyllandet av kraven inte ger utl\u00e4nningen en absolut r\u00e4tt till beviljande av tillst\u00e5ndet; beslutet \u00e4r f\u00f6rem\u00e5l f\u00f6r ministeriets sk\u00f6nsm\u00e4ssiga bed\u00f6mning. Innehavaren av ett tidsobegr\u00e4nsat arbetstillst\u00e5nd \u00e5tnjuter samma r\u00e4ttigheter som innehavaren av ett l\u00e5ngvarigt uppeh\u00e5llstillst\u00e5nd och \u00e4r, med undantag f\u00f6r r\u00f6str\u00e4tt, tilltr\u00e4de till offentlig tj\u00e4nst och milit\u00e4ra f\u00f6rpliktelser, i princip likst\u00e4lld med turkiska medborgare.<\/p>\n<p>Det sj\u00e4lvst\u00e4ndiga arbetstillst\u00e5ndet ger slutligen utl\u00e4nningar m\u00f6jlighet att bedriva verksamhet som egenf\u00f6retagare i Turkiet, i eget namn och f\u00f6r egen r\u00e4kning. Detta tillst\u00e5nd utf\u00e4rdas f\u00f6r best\u00e4md tid och kr\u00e4ver att den s\u00f6kande uppfyller s\u00e4rskilda villkor avseende utbildningsniv\u00e5, yrkeserfarenhet och ekonomiskt bidrag.<\/p>\n<h2>Ans\u00f6kningsf\u00f6rfarande och Tidsfrister<\/h2>\n<p>Ans\u00f6kan l\u00e4mnas in av arbetsgivaren elektroniskt via ministeriets e-\u0130zin-system. Den utl\u00e4ndske arbetstagaren kan inte l\u00e4mna in ans\u00f6kan f\u00f6r egen r\u00e4kning; arbetsgivaren agerar alltid i egenskap av s\u00f6kande. Vid ans\u00f6kan fr\u00e5n utlandet har arbetsgivaren trettio dagar fr\u00e5n den dag konsulatet utf\u00e4rdade referensnumret p\u00e5 sig att l\u00e4mna in ans\u00f6kan. Om ans\u00f6kan inte l\u00e4mnas in inom denna tid upph\u00f6r referensnumret att g\u00e4lla och f\u00f6rfarandet m\u00e5ste inledas p\u00e5 nytt.<\/p>\n<p>Ministeriet \u00e5tar sig att behandla ans\u00f6kan inom trettio arbetsdagar. Om tillst\u00e5ndet beviljas en utl\u00e4nning som befinner sig utanf\u00f6r Turkiet m\u00e5ste denne resa in i landet inom sex m\u00e5nader fr\u00e5n utf\u00e4rdandedatumet. F\u00f6rnyelse av ett befintligt arbetstillst\u00e5nd m\u00e5ste s\u00f6kas senast sextio dagar innan tillst\u00e5ndet l\u00f6per ut; en ans\u00f6kan som l\u00e4mnas in efter det att tillst\u00e5ndet har upph\u00f6rt att g\u00e4lla tas inte upp till pr\u00f6vning.<\/p>\n<h2>R\u00e4ttsliga F\u00f6ljder vid \u00d6vertr\u00e4delse<\/h2>\n<p>Att arbeta utan giltigt arbetstillst\u00e5nd medf\u00f6r allvarliga r\u00e4ttsliga konsekvenser f\u00f6r s\u00e5v\u00e4l den utl\u00e4ndske arbetstagaren som f\u00f6r arbetsgivaren inom ramen f\u00f6r turkisk r\u00e4tt. B\u00e5da kan \u00e5l\u00e4ggas administrativa ekonomiska sanktioner. Den utl\u00e4ndske arbetstagaren kan dessutom utvisas och bel\u00e4ggas med inresef\u00f6rbud. Arbetsgivaren \u00e4r i s\u00e5dant fall \u00e4ven ansvarig f\u00f6r kostnaderna f\u00f6r utvisning och \u00e5ters\u00e4ndande.<\/p>\n<p>N\u00e4r ett arbetstillst\u00e5nd l\u00f6per ut utan att ha f\u00f6rnyats i tid har den utl\u00e4ndske arbetstagaren en residualtid om tio dagar p\u00e5 sig att ans\u00f6ka om uppeh\u00e5llstillst\u00e5nd och bibeh\u00e5lla sin lagliga vistelser\u00e4tt. \u00d6verskrids \u00e4ven denna frist kan utvisning f\u00f6lja. Om utl\u00e4nningen d\u00e4remot innehar ett separat uppeh\u00e5llstillst\u00e5nd garanteras den lagliga vistelser\u00e4tten av detta \u00e4ven om arbetstillst\u00e5ndet upph\u00f6r att g\u00e4lla.<\/p>\n<h2>S\u00e4rskilda Kategorier<\/h2>\n<p>Turkisk r\u00e4tt inneh\u00e5ller en rad s\u00e4rskilda best\u00e4mmelser f\u00f6r specifika kategorier av utl\u00e4nningar. Utl\u00e4ndska medborgare som \u00e4r gifta med en turkisk medborgare kan komma i fr\u00e5ga f\u00f6r undantag fr\u00e5n skyldigheten att inneha arbetstillst\u00e5nd. Utl\u00e4nningar som har ans\u00f6kt om internationellt skydd eller som har beviljats status som villkorlig flykting kan ans\u00f6ka om arbetstillst\u00e5nd sex m\u00e5nader efter datumet f\u00f6r skyddsans\u00f6kan. Utl\u00e4ndska studenter som \u00e4r inskrivna vid en turkisk institution f\u00f6r h\u00f6gre utbildning kan efter det f\u00f6rsta l\u00e4s\u00e5ret ans\u00f6ka om arbetstillst\u00e5nd; studenter p\u00e5 kandidat- och masterprogram f\u00e5r endast arbeta deltid, medan doktorander inte omfattas av n\u00e5gon s\u00e5dan begr\u00e4nsning.<\/p>\n<p>En separat och s\u00e4rpr\u00e4glad reglering g\u00e4ller f\u00f6r innehavare av det s\u00e5 kallade Turkosa kortet (Turkuaz Kart), ett kombinerat arbets- och uppeh\u00e5llstillst\u00e5nd f\u00f6rbeh\u00e5llet h\u00f6gkvalificerade utl\u00e4ndska arbetstagare och investerare.
