K\u00e4nnedom om dessa r\u00e4ttigheter \u00e4r avg\u00f6rande f\u00f6r varje fastighets\u00e4gare som ing\u00e5r ett hyresf\u00f6rh\u00e5llande i Turkiet.<\/p>\n<h2>R\u00e4tten att Erh\u00e5lla Hyra i R\u00e4tt Tid<\/h2>\n<p>Den mest grundl\u00e4ggande r\u00e4ttigheten f\u00f6r en hyresv\u00e4rd enligt turkisk hyresr\u00e4tt \u00e4r r\u00e4tten att f\u00e5 hyran betald i sin helhet och i r\u00e4tt tid. N\u00e4r en hyresg\u00e4st inte fullg\u00f6r sin betalningsskyldighet l\u00e4mnas hyresv\u00e4rden inte utan r\u00e4ttsliga medel. Turkisk r\u00e4tt f\u00f6reskriver ett formellt dr\u00f6jsm\u00e5lsf\u00f6rfarande enligt artikel 315 i den turkiska obligationslagen, som ger hyresv\u00e4rden r\u00e4tt att skicka ett skriftligt betalningskrav med en angiven tidsfrist. Om hyresg\u00e4sten inte efterkommer kravet kan hyresv\u00e4rden inleda ett verkst\u00e4llighetsf\u00f6rfarande via domstol eller kronofogdemyndighet och samtidigt yrka p\u00e5 b\u00e5de indrivning av obetald hyra och avhysning av hyresg\u00e4sten.<\/p>\n<p>Ut\u00f6ver ett enstaka betalningsdr\u00f6jsm\u00e5l ger turkisk r\u00e4tt hyresv\u00e4rden \u00e4ven r\u00e4tt att beg\u00e4ra avhysning genom det s\u00e5 kallade mekanismen med &#8221;tv\u00e5 befogade p\u00e5minnelser&#8221;. Om en hyresg\u00e4st under ett hyres\u00e5r f\u00f6ranleder hyresv\u00e4rden att skicka tv\u00e5 giltiga skriftliga betalningsp\u00e5minnelser, f\u00f6rv\u00e4rvar hyresv\u00e4rden r\u00e4tten att v\u00e4cka avhysningstalan efter utg\u00e5ngen av den hyresperioden. Denna mekanism ger hyresv\u00e4rdar en strukturerad och r\u00e4ttsligt erk\u00e4nd v\u00e4g f\u00f6r att hantera kroniskt sena betalare.<\/p>\n<h2>R\u00e4tten till \u00c5rlig Hyresh\u00f6jning<\/h2>\n<p>Turkiska hyresv\u00e4rdar har r\u00e4tt att h\u00f6ja hyran vid varje f\u00f6rnyelse av hyresavtalet. Sedan den 1 juli 2024 har det tillf\u00e4lliga lagstadgade taket som tidigare g\u00e4llde f\u00f6r bostadshyror avskaffats, och hyresh\u00f6jningar regleras \u00e5terigen av standardregeln i artikel 344 i den turkiska obligationslagen. Enligt denna best\u00e4mmelse f\u00e5r en \u00f6verenskommen hyresh\u00f6jning inte \u00f6verstiga den tolv m\u00e5naders genomsnittliga f\u00f6r\u00e4ndringen i konsumentprisindex (T\u00dcFE), som publiceras av Turkiets statistikmyndighet (T\u00dc\u0130K). Detta tak g\u00e4ller f\u00f6r bostadshyror; h\u00f6jningar f\u00f6r lokaler kan f\u00f6rhandlas fritt mellan parterna, \u00e4ven om T\u00dcFE-indexet fortsatt utg\u00f6r det lagstadgade maximumet.<\/p>\n<p>F\u00f6r hyresavtal som har varit i kraft i mer \u00e4n fem \u00e5r f\u00f6rv\u00e4rvar hyresv\u00e4rden en ytterligare och betydelsefull r\u00e4ttighet: r\u00e4tten att v\u00e4cka talan om fastst\u00e4llande av hyra (kira tespit davas\u0131) vid tingsr\u00e4tten. I s\u00e5dana f\u00f6rfaranden \u00e4r domstolen inte bunden av T\u00dcFE-taket utan kan i st\u00e4llet fastst\u00e4lla en marknadsm\u00e4ssig hyra med h\u00e4nvisning till j\u00e4mf\u00f6rbara fastigheter i omr\u00e5det, bed\u00f6mda av en sakkunnig. Denna r\u00e4ttighet speglar lagstiftarens erk\u00e4nnande av att l\u00e5ngvariga hyresf\u00f6rh\u00e5llanden kan leda till att hyran sjunker betydligt under r\u00e5dande marknadsv\u00e4rden.<\/p>\n<h2>R\u00e4tten att Avhysa Hyresg\u00e4sten<\/h2>\n<p>Turkisk hyresr\u00e4tt begr\u00e4nsar de grunder p\u00e5 vilka en hyresv\u00e4rd kan beg\u00e4ra avhysning, men f\u00f6reskriver tydligt definierade och genomdrivbara avhysningsr\u00e4ttigheter under specifika omst\u00e4ndigheter.<\/p>\n<p>En av de mest frekvent till\u00e4mpade \u00e4r avhysning p\u00e5 grund av personligt behov (ihtiya\u00e7 nedeniyle tahliye), som regleras i artikel 350 i den turkiska obligationslagen. Om hyresv\u00e4rden, dennes make eller maka, sl\u00e4ktingar i rakt upp- eller nedstigande led eller andra personer som hyresv\u00e4rden enligt lag \u00e4r underh\u00e5llsskyldig mot genuint beh\u00f6ver fastigheten f\u00f6r eget boende eller kommersiellt bruk, kan hyresv\u00e4rden v\u00e4cka avhysningstalan. Behovet m\u00e5ste vara verkligt och uppriktigt; turkiska domstolar granskar s\u00e5dana yrkanden noggrant, och Yarg\u0131tay (Turkiets h\u00f6gsta domstol) har slagit fast att n\u00f6dv\u00e4ndigheten m\u00e5ste styrkas med konkret bevisning och inte enbart kan p\u00e5st\u00e5s i allm\u00e4nna ordalag.<\/p>\n<p>En hyresv\u00e4rd kan ocks\u00e5 beg\u00e4ra avhysning n\u00e4r fastigheten kr\u00e4ver omfattande ombyggnad eller n\u00f6dv\u00e4ndiga renoveringsarbeten som inte kan utf\u00f6ras medan hyresg\u00e4sten kvarst\u00e5r i lokalen. Denna r\u00e4ttighet, som ocks\u00e5 \u00e5terfinns i artikel 350, ger hyresv\u00e4rden r\u00e4tt att \u00e5terta besittningen av fastigheten under arbetenas varaktighet, under strikta processuella villkor.<\/p>\n<p>Turkisk hyresr\u00e4tt ger d\u00e4rut\u00f6ver hyresv\u00e4rden r\u00e4tt att s\u00e4ga upp hyresavtalet efter tio \u00e5r utan att ange sk\u00e4l, f\u00f6rutsatt att skriftlig upps\u00e4gning l\u00e4mnas minst tre m\u00e5nader f\u00f6re utg\u00e5ngen av den aktuella hyresperioden. Denna r\u00e4ttighet, som \u00e4r fastst\u00e4lld i artikel 347, ger hyresv\u00e4rdar ett yttersta r\u00e4ttsmedel f\u00f6r att \u00e5terf\u00e5 besittningen av sin egendom efter ett l\u00e5ngvarigt hyresf\u00f6rh\u00e5llande utan att beh\u00f6va bevisa n\u00e5gon specifik upps\u00e4gningsgrund.<\/p>\n<h2>R\u00e4tten att Utf\u00f6ra Renoveringar och \u00c4ndringar<\/h2>\n<p>Enligt artikel 320 i den turkiska obligationslagen beh\u00e5ller hyresv\u00e4rden r\u00e4tten att utf\u00f6ra f\u00f6rb\u00e4ttringar, renoveringar och andra \u00e4ndringar av den hyrda fastigheten under hyresavtalets l\u00f6ptid, f\u00f6rutsatt att dessa arbeten inte kr\u00e4ver att hyresavtalet s\u00e4gs upp och \u00e4r av s\u00e5dan art att hyresg\u00e4sten sk\u00e4ligen kan f\u00f6rv\u00e4ntas t\u00e5la dem. Vid ut\u00f6vandet av denna r\u00e4ttighet \u00e4r hyresv\u00e4rden skyldig att ta vederb\u00f6rlig h\u00e4nsyn till hyresg\u00e4stens intressen, och hyresg\u00e4stens r\u00e4ttigheter till hyresneds\u00e4ttning och ers\u00e4ttning f\u00f6r eventuell uppkommen skada kvarst\u00e5r of\u00f6r\u00e4ndrade. Denna best\u00e4mmelse ger hyresv\u00e4rdar en meningsfull grad av operativ kontroll \u00f6ver sin egendom \u00e4ven under hyresperioden.<\/p>\n<h2>Retentionsr\u00e4tten \u00f6ver Hyresg\u00e4stens L\u00f6s\u00f6re<\/h2>\n<p>Ett av de mest utm\u00e4rkande inslagen i turkisk hyresr\u00e4tt \u00e4r hyresv\u00e4rdens lagstadgade retentionsr\u00e4tt (hapis hakk\u0131) \u00f6ver det l\u00f6s\u00f6re som finns i den hyrda fastigheten. Artikel 336 i den turkiska obligationslagen f\u00f6reskriver f\u00f6ljande:<\/p>\n<p><em>&#8221;Vid uthyrning av fast egendom har hyresv\u00e4rden retentionsr\u00e4tt \u00f6ver det l\u00f6s\u00f6re i den hyrda fastigheten som tj\u00e4nar till att inreda eller anv\u00e4nda denna, som s\u00e4kerhet f\u00f6r upp till ett \u00e5r f\u00f6rfallen hyra och sex m\u00e5naders l\u00f6pande hyra.&#8221;<\/em><\/p>\n<p>Denna r\u00e4ttighet fungerar som en lagstadgad pantr\u00e4tt som ger hyresv\u00e4rden r\u00e4tt att kvarh\u00e5lla hyresg\u00e4stens m\u00f6bler, vitvaror och annat kvalificerande l\u00f6s\u00f6re som s\u00e4kerhet f\u00f6r obetald hyra. Retentionsr\u00e4tten omfattar inte egendom som \u00e4r undantagen fr\u00e5n utm\u00e4tning enligt turkisk r\u00e4tt. Om hyresg\u00e4sten f\u00f6rs\u00f6ker flytta ut eller avl\u00e4gsna sina tillh\u00f6righeter ger artikel 338 i samma lag hyresv\u00e4rden befogenhet att ans\u00f6ka hos tingsr\u00e4tten eller kronofogdemyndigheten om ett beslut om kvarh\u00e5llande av tillr\u00e4ckligt med l\u00f6s\u00f6re f\u00f6r att t\u00e4cka den utest\u00e5ende skulden. Om de aktuella f\u00f6rem\u00e5len avl\u00e4gsnas i hemlighet eller med v\u00e5ld kan de \u00e5terf\u00f6ras till fastigheten med hj\u00e4lp av polisen inom tio dagar.<\/p>\n<h2>R\u00e4tten till Skadest\u00e5nd vid Skada p\u00e5 Fastigheten<\/h2>\n<p>N\u00e4r en hyresg\u00e4st l\u00e4mnar fastigheten har hyresv\u00e4rden r\u00e4tt att inspektera egendomen och kr\u00e4va ers\u00e4ttning f\u00f6r skador som g\u00e5r ut\u00f6ver normalt slitage. En hyresg\u00e4st \u00e4r skyldig att \u00e5terl\u00e4mna den hyrda fastigheten i det skick den mottogs, med h\u00e4nsyn endast till f\u00f6rslitning som \u00e4r h\u00e4nf\u00f6rlig till normalt bruk. Om hyresg\u00e4sten genom v\u00e5rdsl\u00f6shet eller missbruk har orsakat skada p\u00e5 fastighetens konstruktion, fasta inventarier eller installationer, kan hyresv\u00e4rden v\u00e4cka skadest\u00e5ndstalan. Denna r\u00e4ttighet kan ut\u00f6vas oberoende av eventuell deposition som st\u00e4lldes vid hyresf\u00f6rh\u00e5llandets ing\u00e5ende.<\/p>\n<h2>R\u00e4tten att S\u00e4ga upp Avtalet vid Kontraktsbrott<\/h2>\n<p>N\u00e4r en hyresg\u00e4st v\u00e4sentligt bryter mot hyresavtalets villkor \u2014 genom att anv\u00e4nda fastigheten f\u00f6r andra \u00e4ndam\u00e5l \u00e4n de som avtalats, genom att st\u00f6ra grannar, genom att vidta otill\u00e5tna strukturella \u00e4ndringar eller genom att hyra ut i andra hand utan hyresv\u00e4rdens skriftliga samtycke \u2014 f\u00f6rv\u00e4rvar hyresv\u00e4rden r\u00e4tten att beg\u00e4ra upps\u00e4gning av hyresavtalet p\u00e5 grund av kontraktsbrott. Turkiska domstolar bed\u00f6mer s\u00e5dana \u00f6vertr\u00e4delser fr\u00e5n fall till fall, och av hyresv\u00e4rdar f\u00f6rv\u00e4ntas i allm\u00e4nhet att de l\u00e4mnar en formell skriftlig varning innan de inleder ett r\u00e4ttsligt f\u00f6rfarande. Kravet p\u00e5 skriftligt samtycke f\u00f6r andrahandsuthyrning \u00e4r uttryckligen fastst\u00e4llt i turkisk hyresr\u00e4tt, och varje andrahandsuthyrning som ing\u00e5s utan s\u00e5dant samtycke ger hyresv\u00e4rden grund att beg\u00e4ra upps\u00e4gning av avtalet.<\/p>\n<h2>Beh\u00f6rig Domstol och Tvistl\u00f6sning<\/h2>\n<p>I Turkiet faller tvister som uppst\u00e5r ur hyresavtal under beh\u00f6righeten f\u00f6r tingsr\u00e4tten (Sulh Hukuk Mahkemesi). Sedan inf\u00f6randet av obligatoriska medlingskrav i civilr\u00e4ttsliga \u00e4renden \u00e4r hyresv\u00e4rdar i m\u00e5nga fall skyldiga att f\u00f6rs\u00f6ka medling innan de v\u00e4cker talan vid domstol.
